PayPal - Credit Card Company Files Dispute

How would someone know if a member of paypal filed a dispute with their credit card company which resulted in the credit card company filing a dispute with paypal? I thought there was some kind of process where the user of paypal would file a dispute, give his / her reason then escalate it to have paypal review the case.

For some reason, it went directly to paypal reviewing the case and I have not been able to get in contact with the person who filed the dispute. Does this mean the user filed a dispute with his credit card company instead of filing it directly through paypal?

If someone wouldn't mind answering this question, I would greatly appreciate it.

Yes. The person files a chargeback against paypal and they create a claim immediately. The way a chargeback works, the issuing bank removes the funds automatically. In this case it would be from paypal since they are the 3rd party processor. Since paypal has already lost the money, they skip the dispute process and go straight to a claim.

The only thing you can do at this point is to provide whatever documentation they are after.

 

Well if the person filed a chargeback with CC company, then he, paypal, and u all r in trouble. Because paypals ToS says that u waive off all ur rights to chargeback with paypal and blah blah blah.

But, one of my buyer filed Chargeback and then I spoke to her and she agreed to takeback her chargeback and then she called her bank and informed to cancel the chargeback. I spoke to paypal and paypal said that it may take 5-7 days before I can get my money.

But its more than 24 days and I am STILL waiting for my money.

Its 402$.

24 days is a pretty long time since the money is generally returned within 7-10 days after the dispute is withdrawn. Did you double check with paypal as to whether the dispute has been truly withdrawn?

I hope your buyer is an honest person and she is not lying to you....

It is PayPal's standard practice to dispute unwarranted chargebacks. Using
the information you provided, we are in the process of disputing this
chargeback with the buyer's card issuer.

Because the card issuer has reversed this charge, PayPal is temporarily
holding an amount equal to the disputed funds until this matter is
resolved. If the card issuer decides the case in your favor, the funds will
be available in your PayPal account.

The credit card company has charged PayPal a settlement fee for this
chargeback. In accordance with the terms of the PayPal User Agreement, we
have debited your PayPal account to cover this fee.


In a chargeback case, decision timeframes are determined by the card
issuer, rather than PayPal. We're required to allow card issuers up to 75
days to decide whether they’ll issue a credit to your buyer.

You'll be responsible for the amount of the chargeback until the card
issuer reaches its decision. If your PayPal account balance is negative
because of this, please add funds to your account as soon as possible.

Yeah, I just lost my dispute of $410 dollars to an asshole that bought a site from me. He even still has the files I sold to him up on his server, but that wasn't good enough for paypal. Not only that, But I have emails from this guy clearly stating he was ready to send the payment of $410 dollars. So I guess what we should all do is purchase something with a credit card, get what ever it is we are getting then file a dispute to get our money back. This way we are "stealing" legally.. I never knew there was a legal way to steal something, with paypal... anything is possible.

 

This sort of intentional chargeback BS is called friendly fraud. It is illegal, and you can file a police report against them. You can also sue them in small claims court, and if you can prove that you did deliver them what was agreed upon, it's completely possible to get a judgement in your favor. If you're not in the same location as them, it is probably difficult to effectively do either of these, but there is potential recourse.

 

What should I do ?

 

well i think you lost all you could do next time dont use paypal and use the payment details directly like those millions of large official websites do. charge back is a serious issue that allows as another poster stated "legal stealing" thus it is very problematic for the seller as he has to ensure that the user doesnt charge him back

Spoke to customer and she says that in her statement, it says that she already paid 402$.

She paid me on 14th April and filed for chargeback on 5th of May 2009.

May be she cancelled the chargeback but it NOT reflecting on her statement.

Pl advice.

 

I can only speak for myself but I honestly believe she is pulling a fast one on you, telling you want you want to hear, not what you need to hear ( the truth )

 

Or is it that in her current statement , it shows that she paid as she paid on 14th and may be on her next statement, it will reflect as credit amt to her. May be in June statement around 5th of June or so ???
