Copied post outrank my original post??

    hello all,

I have an article on my blog, that I published in February starting and someone copied it and posted on his blog(without mentioning the reference URL). Now what I see, his copied post is ranked on top outranking my original post.

What you think, is it possible if one copied post could outrank the original post in Google search engine. I really don't know if in my case it has been visible on top by some serious error in Google algo. Because, if it is not due to error, then everybody will start coping content from other sources and would be visible on top. Then who will say "content is king"

well I guess such things can happen if he's more active in getting backlinks... And Google did not penalize him only because it was just one instance of duplicating.. Is it an exact copy or just re-written?

has he tried becoming an internet vigilante? Not if he has any sense. A better way would be to construct the content so that even if anyone steals it, it still does something for him. Embed the domain name, for example in a way that is hard to mess with. Like watermarking an image, if you will...

Perhaps this will help... It's an except from my response to a similar post a few days ago about how a duplicate content page could have a higher PR and also rank higher than the original:

The bottom line is all the duplicate content needs to outrank the original is more inbound links from relevant pages on other sites with keywords from the search phrase and/or better linking structure and link text used to link to the page on their own site and/or more domain trust and/or better <title> elements and/or better <h1> elements. There are LOTS of reasons why, none of which are a bug or "error" in Google's algorithm.

Thats great if you have already reported the matter in Google DCMA....... Once the DCMA is issued then the illegal copy will soon disappear from the results.......

Go to copyright basics at http://www.copyright.gov/
    and see these two things

WHAT IS NOT PROTECTED BY COPYRIGHT

in my humble opinion this issue can be complained as duplicate content issue but not in copyright claim :)

Google is not perfect. I am betting that they have tons of flaws in their systems as well. Perhaps it is because his page was crawled first?

It is absolutely a copyright issue (and copyrights are automatic upon creation) - and no copyright filing is needed to file a DMCA.

I think from so many dupilication out there Google has no more serious concern about this ,your file is already there at Google and if they are serious I believe Google already set up application to handle the situations that I think already happen at the first time Google born to serve
