Can I get canned for embedding YouTube videos?

Can I potentially get in trouble for embedding youtube videos of movie trailers on my website?

As far as I know movie trailers are copyrighted material. On the other hand youtube has agreements with some copyright holders which makes sharing and embedding some of the trailers legal. some trailers get pulled from youtube or are explicitly prohibited to be embedded. other than that there is no way of knowing how legal one or another video is.

Can I assume that whatever copyright problems there will be it will be youtube's problems not mine?

It would be the user who uploaded who would get 'canned', not you.

In theory it should not be illegal, however recent court cases (see other embedding court cases) would argue that you could be encouraging piracy.

I assume though, as long as you delete something if someone asks you to...you should be ok. I suggest you hire a lawyer though, just encase.

No. It all depends on the legal team of whoever is offended. You can expect your name to be dragged in the mud along with youtube & any other participating sites if they wanted to.

Whether or not they have a solid case doesn't really matter unless you're willing to pony up big legal fees defending yourself

Make sure you offer an option for the copyright holders to request the video to be removed from your site.
