Hello, I purchase a domain name call ebaytrustedsellers.com when I first got it I develope an original idea for the site. Once I upload the site and make it live in ( I believe) 2 to 3 days, ebay contact me and told me I can not run any service with that name. And to make a long email that I got from them short. They told me godaddy should have not sell that name to me. Do you think I should keep it? If I can't sell it what should I do with it. Thanks
Ebay is a trademarked name and they do not like other people using their trademarked name. So it looks like, you are SOL!
If the email was legitimate .... the reason they contacted you was because of trademark violation. You can keep it, but the only thing you can do is just let it expire. I'm sure others here will agree with me, if not I'm sure they will give you better advise.
iowadawg,I know it's a trade mark but I did some research before I purchase it. I found hundreds of other website with the "ebay" name in the domain name. If you go on ebay auction and type in ebay website you will see some there too. So why mind have to be the one with an issue. And what does godaddy go to do with what we purchase? Thanks
Sites using their name a letter. Most just die out as stated. Just because you can register a name does not mean it is legit to do so. Right now, Ford Motor Co. is going after sites using their branded names, like Mustang, etc. All companies with trademarks do this to protect their name.
post what the email said, based upon the validity, maybe we can tell you if the email was real or not.
Yeah, I guess you're right. It's a trade mark which I knew. They didn't bother me with the other domain name I bought "trustedebayers.com" but I guess ebaytrustedsellers is a name that will make it bad for people who are looking to buy from ebay.
Yes, first verify the authencity of the email. If it is indeed from eBay, you may want to consider your next move based on the potential of your website.
I read a story somewhere about how ebay did a similar thing to a website who were called www.perfumebay.com the last part says ebay, big deal, I think they won the case, perfumebay that is.
A few years back I registered a domain called googlebay.com. As soon as I registered it, I started working on a site for it. The site was a 'webmaster tools' type of site. I had the site finished before the domain even finished propogation. No more than 5 days after launching the site, I got a letter from both Google and eBay's lawyers stating that I must relinquish the domain in order to avoid legal action. I immediately seeked the help of my attorneys and the bottom line was this: Did I really want to spend loads of money (God knows both Google and eBay had more than I did) in lawyer fees and court costs, or did I just want to be done with it and relinquish the name? Needless to say, I relinquished the domain and to this day (years later) Google still has ownership of the domain, as well as the .net, and .org versions.
ebay is a trademark - it has nothing to do with if your site is pro ebay, both names are trademark infringement. You can't use "ebay" + anything else for any domain name. The only exception might be if you had a name like e-bayfishing and it dealt with fishing spots, but had absolutely nothing to do with the auction site "ebay".
The name is worthless. You can register it but you can't use it. You are violating a trademarked name.
After reading this it suprises me that paypal (who are the same company as ebay) have not got rid of websites such as paypalsucks.com
Because that site falls under an opionated site. Just like powersellersunite.com i believe there are certain restrictions, paypalsucks.com isn't a commercial site etc.
Such a site could be commercial - In this case, the courts have ruled that ****-sucks falls under free-speech and an average person wouldn't normally confuse such a site as being operated by the trademark holder. powersellersunite is a commercial site (runs advertising or anything that generates any type revenue, even "donations for bandwidth". IMO, ebay could probably claim infringement on such a site if they wanted too.
Correct, buy they couldn't use the site as a person to person payment service. Back to the original topic, if the user uses ebaytrustedsellers.com as a commercial or auction type site, then he would definately have eBay knocking at his door. If he chooses to use it as an opinionated forum etc he would be OK. IMHO, I would ditch the name as I don't see a site being worth developing. Most power sellers have their own forums on eBay. There would be no real benefit to have their own site.
