Google Adsense DMCA Complaint

    I received a letter from google that they are disabling all ads to the infringing URLs. Prior to receiving this letter I have voluntarily removed all the infringing URLs.

    What if I don't respond to google Adsense within 10 days, what can they do to me?

    I don't want to respond because they want me to provide my complete informations from name, address, phone number to email address and they want me to consent to the jurisdiction of Federal District Court
    for the judicial district in which my address is located (or Santa Clara
    County, California if my address is outside of the United States), and
    that I accept service of process from the person who provided
    notification under subsection (c)(1)(C) or an agent of such person.

    I am very confused if I provide my informations, the person who provided the notification can go after me.

    I already removed all the content from my site. I just dont want any further problems. I didn't know that embedding of video is illegal.

    What should I do? Who can I ask for help? How much fine will they impose to me?

    Please help. I am bothered.

    generally adsense disables the ads on a particular site if its something like warez linking or illegal content kinda

    you said "embedding of video is illegal" so wat kinda video is that ? and was the video source leeched ? i mean you are using other site video source link for streaming on your site?



    not giving your details wont save you from the person to go after you. its better to agree if you had done anything wrong ...you have a chance to say you didnt know that it was illegal and you will not repeat that infuture
    to save your adsense or your self... first reply to adsense saying that you had removed the content that was violating and then proceed

    not reply to the email or notice might make the situation more horrible

    I am embedding videos that can be found from youtube, megavideo, google video etc.

    so if I don't response to google, they will just disable my google adsense account. anyways, I am not after with my earning because I make only few bucks a day. Its not worth the hassle I will get.

    embedding videos that can be found from youtube wont be a big problem because you are not hosting them directly... adsense is disabled for embedding video when you are embedding videos like movie related ie piracy kinda video uploaded to metacafe or youtube or someother site

    so initially they stop displaying ads on that site..later might ban whole account too

    You can still be sued for embedding videos that are not hosted on your site. If you display copyrighted material, the owner can sue you for damages and/or a usage fee - and even if you have removed the content. I don't know if the whole story is being disclosed, but you should probably consult an attorney. Even if you don't provide contact information, your contact information can be obtained via a court order. They can even serve your ISP and force them to provide it.

    when you upload a video to youtube if public embedding is enabled then anyone can embed that video...

    unless you embed a video and oppose or comment something on the video which makes the author feel that it is causing damage then he can sue

    i think any one is free to embed a video from youtube that has public embedding enabled (excluding the pirated copy videos of movies etc)

    correct me if i am wrong

    As far as youtube goes, you are free to embed a video that has public embedding enabled provided you follow their tos - but youtube isn't the copyright holder so doesn't mean you can't be sued if the material was uploaded to youtube illegally. I suspect most copyright holders wouldn't go after a site embedding youtube videos, however, it isn't a guarantee.

    A site owner is responsible for all content running on their site and having express permission from the copyright holder of any content running on their site. Youtube can't grant copyright permission for content they don't legally have the right to display.

    Since you agreed to abide by AdSense Terms of Service... at best Google will provide the plaintiff a balance equal to your last 3 months of AdSense revenue... and ban you from AdSense for life.

    Don't give out your information. If the person is truly determined to get your information, he/she can file a subpoena to get it which is extra work. He'll probably forget it and move on
