As far as I know, if you start a site offering illegal downloads (if you don't hold distributor rights, then it's illegal), then you will be acting against Google's TOS and therefore are likely to get banned. What niche is your current site in that earned $0.29 for 1 click?
Yep he's right you'll be banned if you use them on an illegal downloads site. If the free software site is just freeware, or your own free software that you created, then you should be fine.

It will be no problem if you link only to demo version or freewares. Software Download site is ok unless you link to illegal and pirated copy of the software.
