Doesn't matter if its a cartoon or not, if you don't have the rights to stream the material it's illegal.

I was asking because I saw Tom and Jerry on youtube and google video, and I thought maybe it is permitted because it is an old cartoon ( a very old one ), and they are not taking them out.

Yes of course. Anything that ever aired on TV is still copyrighted pretty much. I can grantee Cartoon Network still has rights to those shows. Whether they'll take any action if you do make a streaming site is another question entirely.

Part of the reasons why should shows are found on Youtube is because Youtube worked with the film studios (copyright owners) to host them on youtube legally.
And the other half (well more than that really) are pirates who have pirated the medias, uploaded them to youtube, and then exploited youtube by then putting the video on their site and expecting youtube to protect them from DMCA issues. Who can actually tell anymore what;s legit on youtube? Unless you followed a direct link from an official site. Yotube most likely bought rights to the shows to stream if they are official, and if you want the right to stream a show it's going to set your budget back quite a bit. I really doubt the copyright owners are doing it, after all their would be no profit from it.
Well, it depends. Actually most of the licensed contents on Youtube are merely teasers or clips and not the full fledged shows. They are mainly used by studios for the sake of publicity mainly because of the viral nature of youtube and the studios do not need to foot the bill of the massive bandwidth which the clips generate. It depends how much you upload. Trying looking some stuff up on fair use. That said, anything over two minutes of video is probably illegal.
Wow, what a load of crap. Fair use isn't a license to copy all the content you want. Fair use is a provision that enables you to use other people's content to improve your own.
I think it's illegal.. because if you really want to upload it, you should give the anime owner some royalty... But no one cares about the copyright now.. so they didn't process the illegal things like it. Because many people doing the same thing

I am preety sure that if you stream it from a differnt site, then put it on your website that you are not responsible. Just put somewhere in your footer "All Videos are streamed from external websites not affiliated with us"
