Hi! I found a great wallpaper. The website that offers the wallpaper says it's completely free. Is it legal to use parts of the wallpaper for designening the header of my website? Is there any website with information about this?
Depends on what "completely free means". If it means free to use for personal use than no, but if it means free as in the public domain yes you can use it. Check the pictures license for further details.
Look for the part where the site said it is "free to use". If they don't have anything your best bet is to email and ask.
It is worthwhile to be careful. I know there are some wallpaper sites that steal content from various places on the web, then tell people they are "free" to use. The problem is that if you use an image without permission, you are the one who gets in trouble, not the web site that lied to you. Legitimate image sites will have detailed license information available, including information as to how and where you are permitted to use the images. If the site doesn't have that information, personally I'd stay away.
i just saw the wallpaper i want to use on photobucket.com. Members of Photobucket agreed to give away the images submitted free to use and free to modify by accepting their TOS. If i'd take the wallpaper from a member of photobucket.com it should be ok to modify it. shouldn't it?
You have no way to know if the person who posted it to Photobucket had the right to share it. Also, where did you read in the terms that images posted to Photobucket are free for anyone to use? The way I read the terms, people have not given up their rights to the images they post, other than granting Photobucket the right to display them. http://photobucket.com/terms
That gives you a right to display the images, but I don't think it gives you the right to integrate it into a header, for example. The right thing to do is get explicit permission. It also doesn't solve the issue of whether the person who uploaded the image to photobucket had the right to do that in the first place. There are many copyright infringing images there, and if you used one you would be liable.
