If someone who worked for a list management group/affiliate(and signed no contracts of loyalty) in an affiliate network loop of sorts... could aquire many full source records,targeted,permission based emails from several different affiliate lists simply by hitting "export subscribers" from different mailing platforms.Could they then turn around and send targeted data and offers through other affiliates that the employer doesnt use? Starting their own company ofcourse,proper headers,unsubs,suppression/black lists etc.. being Can-Spam compliant as far as the mailing goes.The question of compliance would be with the data and the way they aquired it as they crept out the building.
Things is the 90 or so campaigns sent out daily to a dozen or so lists were not aquired by the people sending them out anyways,nobody signed up to us its just shared/syndicated data that is mailed by dozens or hundreds of different mailers.They opt in to receive other products/offers by ticking the box as they fill out an offer...Therefore what is done daily here is mailing "someone elses" list along with a few dozen other people its shared to aswell.Nobody in this biz cares about the morals of it just making money. Basically you get your name on just one of these lists in the morning and youll have yourself a full box of offers in the afternoon....90% of which are sent by people who had no involvement signing you up. Sleezy and unethical business practice if anything.Its just a curiosity question aswell.
It is illegal to send out emails to those who did not opt-in to your exact service. Such as if the opt-in was for the website xxx.com you could not send them emails for your website yyy.com. It is illegal due to the anti-spam act that says your subscribers must be double-opt in or recorded with name, phone, address, and email via written response which means they must fill out a paper with all the information to give you permission. So what you would be doing would be illegal unless they signed up under your company which would give you permission to send to all of your subsidiaries and entities.
