Making a website and want to make sure it is legal

    so i'm making a new website, with a whole bunch of guides on how
    to hack differant mobile devices and other things etc
    for example
    Jailbreaking the ipodtouch/iphone
    Differant cellphone hacks like custom firmware and stuff
    hacking the psp's firmware

    its not really hacking as such its using programs to do
    all the firmware changes and stuff

    so as long as there just guides on how to do all that stuff its not illegal right?

    Jailbreaking iPhones just violates the TOS with apple and is not illegal in itself. You do have to be worried about butting pirated apps etc on the phone. From what you described though you should be okay.

    ok cool, i just wanted to make sure
    so actually uploading cracked games but hosting them on something like rapidshare would be illegal though right?

    Yes any linking or uploading of cracked games/apps would be illegal.

    I would avoid making a site like this since it promotes questionable activity. if you go to make money off it, i doubt your going to get approved to run any ads at all by affilates

    The other thing that you need to worry about is liability. If you provide the information to hack the phone, etc. and some idiot messes it up and destroys their equipment, you could be liable for providing faulty information. I'd be VERY careful and make sure that you've got a great terms of service...

    If you do it, mention the software, but don't provide it, and i'd recommend reminding users that they may be violating TOS etc, and the consequences of if they did

    If you link to "warez" then make sure you have a host which supports warez-linking. Saves a lot of trouble, hehe!

    You should check with Apple if they are okay with what you are doing and if you think they will not consent to what you are doing, it is best not to go into it. Even if it is a fineline you are standing on, with the might of Apple, I am sure they would crush you legally.

    who cares about Apple,, just dont use any trade marked terms in your URL and your sweet.. they cant do anything to you so long as you dont use their TM'd terms or img's..

    the only thing is how are you going to monetise it? Adsense dont allow this kind of content.. and you can promote anything so long as you tell people its only for information purposes and have a nice BIG disclaimer on the site somewhere... ever seen some of the dodgy stuff on youtube lately?

    The iPhone and iPod Touch are trademarked terms and I am sure it contains patented technologies from Apple. It is going to be very hard to avoiding mentioning the names or referring to Apple's technology if you are referring to reverse-engineering or modifying Apple's products. I am sure they would want to protect their bread n butter. It is not like your information is going to bring you any blessing but pain in the future.

    It is really not a good idea to toy with danger but then again it is your life, you have the freedom to do what you want as long as you accept the consequences of your actions. We can only advise you as if anything happens, we are not going to be responsible for your actions.

    eddy2009 ur obviously paranoid living in a very controlled society that Singapore is.. however your information & scare mongering tactics make me wonder if you are a covert apple employee?

    If I buy an iPhone and tamper with it, change the OS, firmware whatever and then publish it online for other to use then there is no legal issue what soever.. you can mention Apple products on your site too btw.. I was just referring to not registering a domain with any apple TM'd terms...many sites now are dedicated to upgrading 2nd Gen iPods to run linux OS and expand their features..

    And another thing, I am pretty sure Apple do not own the TM on "iPhone".. that term was in use long before Apple came on the scene.. but I would guess "Apple iPhone" would be TM'd...

    That is not entirely true.. Modifying the OS and Firmware would be a violation of the DMCA and recent enhancements to it through the Patriot Act and similar laws.. Now, as a one off doing it personally the odds of you getting prosecuted for it are pretty much nil.. But making a 'business' out of it is playing with fire..

    Remember the guys who tried to make a business of selling OS:X on PC's? They got shut down... fast.
