How to "Steal" a Domain Name

    I was brainstorming one day last week and thought of this great domain name for a new project I was interested in starting. However, when I looked up the availability of the domain name, it was already taken. Crap! However, the individual who registered the domain name wasn't using it for anything - there's no website for the domain name.

    I want this name. I need to have this domain name.

    I contacted the individual who registered it, and they are not even willing to sell it.

    I see that the domain name expires in April 2009, and I was interested in knowing if there's a way to "steal" this domain name when it expires in April.

    I really don't think the individual who owns the domain is very "web-savvy", so I thought about taking advantage of those loop holes when domains expire and purchasing it for myself.

    Any tips on how to acquire this domain name without buying it?

    I meant "steal" in the context of taking it by any means other than buying it (since the seller isn't willing to offer it for sale).

    I don't have a trade mark for the name, but is this a possibility? Could I file a trademark and force the name holder to release the domain name. What's your take on this?

    no you cant.

    thats your fault you should act quickly for registration if you have the name in your mind.

    if you have TM and any body using in bad faith then you can ask them to give

    You have t wait it for expire and then you will be able to acquire it as if it was free.

    I did act quickly. I took action within minutes of thinking of the name, but it was already registered for several months.

    I'm going to research the correlation between the trademark and the domain name and perhaps I can force the individual to give me the domain name (since it's not being used anyway).

    You cant register a trademark now and file arbitration to get the domain name now.... A good lawyer would shred your case to pieces..... unless you are a very very big corporation and the defendent's lawyer is dumb :).

    The best option is to think of another name for your project.... or register the name with another extension...

    best solution is one of three:
    purchase it from the current owner, if he is willing to sell
    wait until expire and place backorder
    go, and find a new domain is better for you!

    as you mentioned the owner is not willing to sell it, all you can do is backorder it, using pool or snapnames, they're the best on catching dropped domains, be ready to spend some cash though

    i have different kind of issue i am registering domain with same name with diffreent letter like putting uk behind it - is it worth to register or leave the plan.

    Instead of spending thousands on getting a trademark and waiting a year to get it approved - just offer him the thousand. :)

    A trademark is meant to protect against consumer confusion, not grant one a
    license to take something that essentially doesn't belong to them. Besides, if
    roles were switched, would you appreciate someone doing that to you?

    It does suck that someone else got what you want and isn't willing to sell it.
    But other options do exist as others stated.

    (Oh well, people violate the 10th commandment every other day...)

    getting a trademark first and then filing for a case, would end up costing you a lot more than what you could have bought the domain, from the current owner, for..I would suggest you to make a decent offer and then proceed..

    Let me get this right...
    You want to force someone to give up a domain because you did not get the name first and they will not sell? Welcome to the real world man!

    My suggestion - Start purchasing names in the after-market or start looking at expired/dropped names.

    I agree, place it on a backorder and forget about it. If you keep hassling him/her then it will only increase the price and they'll also keep it longer.

    If you are writing to them, give them your best offer for the name. If excepted, great! Use something like Escrow for the transaction. If not accepted, you could always say you'll buy another name instead and thank them and then don't contact again.

    more often time, backorders always unsuccessful.
    you may find some good companies around who provide
    "domain-catching" services for a reasonable fee.

    have tried monikker backorders but of almost 50 files backorders,
    nothing is successful :(

    If the domain name you want consists of 2 or more words, why not put "_" or "-" between them?
