I have NO idea what she is talking about

    To whom it may concern:

This is to inform you that a website you manage, sms-thailand.com, has come to the attention of Rosetta Stone Ltd. ("Rosetta Stone").

Rosetta Stone's automated monitoring software continually monitors, collects and stores instances of unauthorized use, sales or other violations of Rosetta Stone's intellectual property rights on the Internet. Our records indicate that your site, sms-thailand.com, has employed an advertising or sales campaign that may have incorporated Rosetta Stone products and/or trademarks or terms confusingly similar thereto.

We believe that there is no legitimate reason or basis for you to rely on any Rosetta Stone trademark, image or product in your marketing or sales campaigns, and encourage you to review all of your advertising campaigns and sites to avoid such practices in the future.

    Sincerely,

    BrandEnforcement@ rosettastone.com
    Rosetta Stone Ltd.

Do you own that site? Do you have anything in your advertising and sales copy that mentions Rosetta Stone? If not, I'd email them back and ask them to point to specific instances of their mark being used and you will be happy to remove them.

    Just my $.02...

"our automated monitoring software continually monitors, collects and stores instances of unauthorized use"

They give you no specifics on the infringement so I think more likely it's just a stupid bot and they are sending out hundreds of these emails. In any case they are not threatening or making demands. I'd ignore them.

Maybe it's just a ploy for their lawsuit against Rocket Languages so they can claim that they take trademark infringement very seriously and have sent out xxx emails this year.

It's possible it's just a spam bot trying to scam you. Are you doing anything that could even be remotely considered to infringe on their trademark? If not you have nothing to worry about.

Rosetta Stone is a pretty big company, well known for courses to learn a foreign language. I don't think they're trying to trick anyone into visiting their website :)

I'd be curious to know how that lawsuit turns out. I use the name of competitors in my adwords campaign too
