Shawn Hogan (Owner of DP) Is Getting Sued For Cooking Stuffing

It's just a allegation and no one can prove that Shawn did is ,we should wait for the court's judgement

It's easy to level charges against anybody with less proof..

 

eBay wouldn't put charges upon someone unless they had some decent proof that it was that person.

So every case filed has merit just because it was filed? Do you not realize how absurd that is.

All it means is that ebay thinks it has a case or has some other reason for filing a lawsuit. It says absolutely nothing about the objective merit of the action.

 

How long has the case been going on? Does anyone has the latest update on the progress here?

No, ebay escalated the case from magistrates to district court. totally uninteresting news IMO

 

There's no smoke without fire. I hope DP stays online.

 

DP is definitely going to stay online, and the owner is still likely going to be Shawn. The issue is, what's the background news going on with the proceedings.

 

DP wont go offline. DP is not related to the case at hand. Even if Shawn was to be put in Jail.. nothing can be done to DP.

 

Certainly, Shawn will need a backup person to administer the DP site, e.g. paid servers, mantaintence, etc.

Oh yes it is. eBay made it a point to name the person and each company separately in the suit. Shawn and DP were each served a separate summons.
So Digital Point is very definitely part of the case.

This is a civil case so going to jail is not even an option. In civil cases they can only sue for damages. (that's my understanding)

Since this is a RICO case they can sue for TRIPLE the damages. (see RICO treble damages)
So if they can prove he defrauded them for 1 million, they can sue him for 3 million plus legal and other fees.

Again, not saying he's guilty or anything, just pointing out some facts in the case.

 

If he were to lose the case and not have money to pay, they could go after his assets... like this website... to sell to raise the money.

 

these are some very high tech allegations. i've had to read it over several times to get a grasp of what was accused. the only thing i know about cookie stuffing is going to the market and eating my heart out.

 

That just like ebay!!! they file a lawsuit against me for have a domain call ebythebay wtf can you not have domain that has e b a y in it? Maybe the assholes should sue ican for letting me register the domain? Ebay is just trying to bully the small guys around, I remember when ebay start out as a moral company now there just after money and they don't care who they have to stab in the back to get it. Oh and btw i have never been stuffed a ebay cookies when i came to dp, ebay is full of shit!!

 

It's not a criminal proceeding, it is a civil one. Period.

 

The case was only filed because eBay loses revenue to DP. As 'site flipping' becomes more popular, eBay wants all the turnkeys and content sites sold on eBay, not DP. They are both venues, and eBay as we all know hates competition. It's about money of course...just business.
