Need a little legal help

    As most movie buffs are aware the new james bond movie is released on 15 october/november....entitled Quantum of solace...

    yes exciting i know :)

    right i'll get to the point....i have the domain name quantumovsolace.com and have nearly finnished the content for the site and will soon be publishing it on the web...

    The content will consist of streaming the movie...quantum of solace.. (from third party eg megaupload, youku etc)...and streaming other bond movies also from third parties... Also the site contains image gallerys (some nudity) of the bond girls (eg Olga Kurylenko...the New bond girl)...

    Now what i would like to know is will they be a possible comeback on this, like trademark, copyright, etc

    Also what information should i be putting in the disclaimer,because i wont be hosting the movie but providing links that host the movie (third party).

    Any feedback will be greatly appreciated.

    Yes, everything about the idea is a legal disaster. From the domain name, to the use, to your stated desire to stream movies you don't own. This thread only serves as concrete evidence of your bad faith.

    There is no disclaimer that allows you to do anything of the things you intend to do.

    Have to agree with Browntwn here. And an important thing to know is that a
    disclaimer is not some absolute magic shield as long as it can be shown you
    are infringing a party's legally enforceable rights.

    only way to pull it off is get one of those off shore companies with a server running on international waters and do not use any of your real info and have all your sponsor accounts pay out in countries where they cant find it as easy. Do alot of research before you dare to give out bootlegs. If you wanted to you could pitch the idea to The writers of the film and see if they want to be the first to release a full motion picture on the web the same day as theaters and sell admission tickets to watch it on that site. They will most likely love the idea and either steal it altogether or give you a nice sum of money for the idea.

    I agree with the rest of the group. This is a particularly bad idea. You're cybersquatting, violating trademark and copyright law. No legal disclaimer could save you from getting sued. I suggest that you cease what you're doing, turn the domain in and live to fight another day...

    For the use of the domain name, <www.quantumovsolace.com>, the questions will be whether there is a likelihood of confusion between your domain and the QUANTUM OF SOLACE trademark and whether your registration and use of the domain was in bad faith.

    As for copyright infringement, the question will simply be whether you displayed, copied, or modified somebody else's copyrighted content (i.e. their movies) without their consent.
