I run MP3 download website. I know that these are illegal but I have made some terms that users must agree before downloading. Please check if all is good and tell me if I need to update it: See My website link in signature and see terms link from footer in my website. After plenty of reading about law I think it goes good now still if you have suggestion do tell me.
What difference are your users gonna create by agreeing to the terms and conditions before downloading? In any case, you will be the first guy to be taken care of because you are hosting the illegal files on your server, without a reasonable knowledge of their legal status. Also, I have seen many Indian MP3 download sites that have following terms: Will somebody ask this webmaster who gave him the 'redistribution' rights to offer review copies?
You can't offer copyrighted songs for download, streaming or anything that doesn't fall under fair use without permission from the copyright owner. You risk being sued/shut down if you run a website that does so, no matter where you are located.
hi! Isn't the terms of service enough- http://www.bollymp3.co.in/terms/ Because I don't host files on my server. All the files are demo songs that must be deleted 24 Hours after review. Songs can only be kept if the downloaded has proper ownership license of the album. I don't rip CD's and bring them online. All these songs are online already at torrent websites or big sites like songs.pk, mp3hungama.com and there are thousands. I simply province users the link. And I also clearly mentioned that the songs are promotional purposes only and the copyrights are with their owners. Is only giving link to already hosted file also illegal? Even after writing full TOS and a link to TOS before users download the file.
The Terms of Service won't protect you. Linking to copyrighted content without permission is contributory infringement, no matter how you cut it. Whether or not the copyright owners will bother suing/shutting you down I can't predict. Some countries provide more protection than others, and if you run a small site you may fall under the radar. That said it is still copyright infringement and you can be sued for it.
