Are Google Images Copyright?

Discussion in 'Legal Issues' started by ryanmacca, Aug 13, 2008.

    Hi,
I am sorry if this question has been asked a million times before but I am creating a website and might sell it when I am finished and I want to use some google images.
Are they copyright or can I use them for free? Do I have to give credit to the webpage I get it from?

Yes the majority of the images found via google image search are copyrighted, don't use them without contacting the image owner first for permission.

Depends on what site the image is hosted on. Google Images just gets you to the images which are hosted by all different sites.

All images, content and artwork have an automatic copyright upon creation. You need permission to use them - regardless of where you find them - and giving credit does not make it legal unless the owner has stated so.

To answer your question, no, I dont think they are... however, all images are copywrited by their respective owners. You can clearly see this info at the top of the google image search page. Google is simply aggregating data, the images in question still belong to someone else.
Google does not own said images, they are merely showing you them.

there is no thing as a uncopyrighted image. There are sites out there that let you use images for free with some ToS in. (i.e. do not resell, don't use for porn/bad websites) so remember to read them xD

A good idea is to grab a camera and take a photo of something... then the picture is yours.

That falls under fair use unless you plan on publishing the project to an audience beyond your school/community.

That is completely wrong. Adding an image source does not give you rights to use a photograph owned by someone else.

When you click on some image and it says about the copyrights, it surely is and you are required to give some credit to the original website, otherwise its fine to use them as such. Personally speaking, I have never seen even a single image without a copyright because if Google talks about the owner's copyrights, most of the times in any site's TOS and privacy policy copyrights are mentioned about every article, image o anything else present on that site. Therefore, why to take a chance mate..:)

No simply citing the image source doesn't give you the right to use the image. You email or contact the image owner and ask them for permission to use the image. At that point it is up to them whether or not they allow you to use the image.

^ Agreed, very bad idea to take a chance...
Contact them... I used to get images from Flickr and ask the person who uploaded if I could use it... most of the time they said yes, (about 99.9% of the time) but think about if I used the 0.01%'s image and they found out... I'd wouldn't stand a chance in court.

That would depend on the license, and how you use it.

However just because somebody says that an image is not copyrighted and puts it up on wiki does not mean that the image is not subject to copyright

All content is copyright by the person who created the content. They do not necessarily have to register it with a copyright agency, but this does make legal proceedings easier as they can prove it was theirs first. Also note that you do not have to display a copyright notice on copyright protected content.

    Hope this helps! :)

I think it's all fair game to use whatever image you find as long as you give credit. If the owner or company comes after you, just remove it.
