    They declared war on us Several years ago but we were not listening. 9/11 made us listen and now the Al Qaeda and the Taliban have to face the consequences.

    I'm no international scholar, but in my mind the first 11 words of the GC would seem to settle the debate.

    We didn't declare war on Iraq or Afghanistan, we "declared war" on terrorism (al quada and the talaban) which are not "states", so by the very definition of the GC itself, it does not and can not apply to "enemy combatants".

    They are not primarily Afghanis. We are not battling Afghanistan. We are battling Al Qaeda and the Taliban, which is made up primarily of foreigners. Take a look at the list of people we have picked up on the battlefield. They are from all over the planet. That makes them mercenaries.

    That DOES NOT make them mercenaries, you have a fundemental flaw in your argument as it does not even come close to the definition of 'mercenary'

    The Al-Qaeda fighers are not mercanaries if the where the same uniform and receive the same pay as the forces they are fighting with. For this reason the French Foreign Legion are not mercenaries.

    During WW2 the Germans had large numbers of foreign fighters in the SS. In fact there were whole divisions of foreigners fighting in German Uniform. The SS had three French Divisions and over 200,000 muslims fought in the german army including serveral SS Division.

    There is more to it than just simple pay or uniforms worn, if you look at the definition they must also be only after money and money alone, large sums, if they are there for a purpose such as religion for example they are NOT a mercenary, uniform or not.
