Its sad such incidents happen but those (as told by many already) who are so much worried of their work really should invest in backup services or atleast do their own backups instead of flaming the hosts. Such incidents happen and instead of trying to rip the reputation of the host, try to learn your mistakes. And you have NO RIGHTS 7point4 to SUE any host as the host when you are receiving web hosting service from a host and not backup and storage services. Its sick to see you people coming here to blame the hosts for issues which are beyond their control.

Agreed newgenservices, anything of importance hosted online should be backed up regularly by the user. NEVER rely solely on your web host to backup data even if they do offer backup services. No method of backup is ever going to be 100%, therefore take all steps necessary to ensure your data is safe.

hose crappy mellowhost hosting companies should be sued and taken out of business ! they had no rights to lose a data.

after investigating the matter, here is what i came out with, i asked my host -hostgator if there is any chance for this to happen to me, here is what they say:

Nothing against HG, but they are considered World's most Oversold host. Did you read their TOS ? God Forbid, But what if the same thing happens to them ? 7point4, First of all its TOTALLY YOUR mistake for not backing up your data and stop blaming Mellow Host or any host for that matter for the loss of your data. You have NO RIGHTS to sue any hosting company for such issues which are beyond control. Please try to understand that no host would like such things to happen and try to cooperate while things get settled slowly.

There terms of service says they're not liable for damages. The same thing is seen in the hostgator terms as well.

No one has ever tried to seek damages so we do not know if the terms would actually hold up in court or not. Frankly it is not worth the money to find out either

you must be their cooperator defending them so badly ??

believe me if this would happen to me i would get my money back

first of all - i would argue they have never informed me on possible crash, secondly they have added tos condition after the incident, third- even if HG state no liability for lost data in their TOs- they would still backup your data ones a week as they say

    ..etc etc etc

i don't believe this mellow host should be in the business, they handled situation very badly, losers ..

as per my rights- i have them all reserved ..

Have no interest to defend or argue with anyone here, just for you:

(This is our terms of service from google cache)
    http://209.85.135.104/search?q=cach...ellowhost+terms+of+service&hl=en&ct=clnk&cd=1

Compare what you are saying with our current TOS.

According to Google this was taken on "as retrieved on 27 May 2008 15:37:48 GMT" (Before crash)

Well i have never even communicated with Mellow host ever and i am neither cooperator or any way related to Mellow Host. I am just telling you the fact. Learn it as a lesson and try to back up your data at least from now onwards.

You can ask for a Money back if you are in the money back period.

No one will anticipate a possible crash even when we carefully monitor the servers.

Well its of no use when you reserve rights of everyone in the world all by yourself :p

by money back- i meant all the money i would lose because of the crash- which would include my time, all costs of the sites..etc

mellowhost has never offered any compensation, partial compensation or help to the people, if they are not willing to compensate, they should have disappeared from from the business, instead of advertising their crappy "best service" all over the Google

Again, No argument, but you are making me to :)

Just wondering, what should we do with the clients filled up with rest 7 servers? I also haven't received answer about your clueless speech regarding our TOS anyway.
