Complete Site Copy of My Web Host

    Hello

    I recently set up www.istati.com

I have now found that rajeshmehtaonline.com has made a complete copy of my site right down to WHMCS.

The only strange thing, is that if someone orders then it goes to the WHMCS of my site so I get the payments and everything.

I couldn't find a host except http://piradius.net/ so I emailed and the domain registrar but I don't think the registrar can do much.

    Any advice?

    Calum

The fact that they copied my entire site and design that I paid money for.

    Reply from the host:

What should I say in response?

Did you design your webpages yourself? Are you a reseller of some another company? Did the reseller company setup the website for you?

It is likely that you and the other guy have purchased reseller hosting from the same company or the reseller companies are using some templates.

UPDATE: I just found observed that the other guy is using your name(iStati) on his website. His livechat support also points to your livechat facility(http://www.istati.com/livechat/live/divert.php?divert=offline&departmentid=). This a amusing!

Just leave it there and get all the business for yourself, free ads. If he turns around and modify his site then you can start to file DCMA report to his ISP and hopefully they'll take it down.

Send them proof that you own the site.

You must fill out a DMCA notice, sign it, and send it to the host. Just google "DMCA template" and you'll find many examples of what you need to do. A host isn't going to take action without you going through the process. You can also send one to google and any other search engine if the host fails to comply and they will remove the offending site from their index.

No, I got a private designer. No, I have dedicated servers, we don't resell anything and I set up everything.

Yeah, thats how we found him. One of my live chat techs said we had an incoming request from a different site so I had a look.

Thanks for the advice, but I want to deal with this. +rep

I know, but what type of proof?

He isn't indexed in Google yet, but I will take your advice and download a DMCA template. +rep

    Thanks for everyones help.

Well, the person who replied to the email says I need an official DCMA notice and proof of ownership. I have gotten a DMCA template, added all my details and am making it into a PDF now.

I also have proof of ownership.

Doesn't matter where the host is...if you send DMCA to Google and other providers...he will NEVER get traffic. It always ticks me off to see this and it's always the same pattern. Anyone want to guess what part of the world he is from? INDIA of course...

Registrar is and Enom reseller. You can also try to DMCA them. Too bad he didn't use Godaddy because they actually lock DNS on people. They also charge a $30 fee to them for the legal paperwork. hehe

Thanks. I actually got a surprising reply from the upstream provider:

That's the reply from my 10 or so page DMCA template that I filled out with all my details.

I might try contacting enom if this doesn't work, but as soon as it get's listed in Google I will send them a DMCA notification as well.

It just looks like they have parked the domain at your host? and don't have design (or any script on there server).

Send a letter to the site's host. Usually hosts are prompt regarding matters like this.

They didn't it is just HTML file copies, there are no scripts running behind anything. The main site files are .php but they are just plain html. The live chat and whmcs is php, but then all of theirs links back to our site.

Yep, I never got a reply from the abuse department after they said they will forward it downstream, but I guess either the person who made the site gave up or my DCMA template (thanks mjewel) worked.
