One of my dedicated servers on a video hosting site i own have been totally wiped out, this is a part of what my hosting company said: now we are talking about over 10,000 videos deleted plus the cost of getting a coder to reinstall the 'new' server with the appropriate scripts. most of these videos belonged to paid clients, some of these users embed these videos on their sites and rely on my sites services as part of their business. I have already received some email asking where the hell their videos have gone and im pretty sure a flood of emails will be coming in soon. questions 1. is there any legal action i can take against the hosting company 2. is there any legal action paid customers can take up against me
1. You may, it will depend on the contract/agreement you have with the hosting company. 2. They can, it will depend on the contract/agreement you have with your clients. Do you have a back up of everything? If so, then your real concern is minimizing your down time. Honestly, don't worry about lawsuits now. Those takes months and there is no rush. You should concentrate on getting everything back up and your own customer service.
i dont have any backups, this is about 5tb of data. Im not sure how such a stupid mistake could have happened... really dont
It's all depends on the T&C stated in the legal agreement. I would advise you to read every clauses closely. Based on my experience dealing with data centers, normally their compensation is limited to certain amount clearly stated in the agreement. Meaning what ever happens / damages caused by their side, they will only be eligible to pay that much amount. In my case which happened to me once, it covers only up to MYR$10,000 ~ US$3144. In most cases the amount is peanuts compares to the loses that we have to bare. Same goes to your client. Hope your legal agreement is strong enough to save guard your position. Hope that helps. Just get everything back up and running, and bill them for all the expenses,time it cost you, and lost revenue. They admitted that it was their mistake; they are taking responsibility for it. So that means they will have to pay you or else you can go to court and they'll have to pay you anyway.
No backups.. o dear. Even if it would be 10tb.. the more eager I would be to have at least a monthly backup. Biggest mistake the webmasters make!!! No emergency contingency plan is close after that.
Well you are looking for is compensation aren't you... Here (law of England and Wales) compensation is paid for actual loses suffered. Which in your case it would be a. advertising revenue b. cost of paying somebody to reinstall the script But it really all depends on what legal jurisdiction the server is in. And of course, the possible cost of paying a solicitor is a factor for you too.
I was thinking 512 kb floppy disks. I guess a multi TB drive makes sense. Pretty easy to set one up too.
Ouch, That sucks, I say you try to bargain on more free months, clients are going to be pissed so send them an email. That really sucks tho, Please post somewhere to let us know about this host, I dont want to be ending up with a host like them.
good point, but having 10tb of data hanging around the internet costs. About $30/mo for a 500gb drive. Having it locally on my pc at home also isnt an option for that amount of data, it would take me weeks if not months of continual uploading to get everything back online. Plus i would have to do that with the rest of the servers as theres is more than 1. Too much money involved and the site is barely covering costs as is. by the way the site is running as unusual, minus 1 sever and 10,000 videos... i'm not sure what im looking for, im just so pissed at the moment. have never heard or experienced anything like this. Geez, even my webhost I run a junk test server with has backups. They should have one from at least a week ago. And that is on a 12 dollar a month plan. How someone can accidentally re-provision an entire machine is beyond me. Sorry to hear about it.
Next time get yourself a nas server. Well you should in this case surely your making more than 50 $ over if you have so many videos so it's well worth it, 2 u's is around what 40$ extra a month? I'd say it's worth it.
