my site is a blog and currently has around 35.000 unique visitors daily...Until the end of the summer it willl surely have surpassed 40.000 perhaps even fifty and I also plan to host a similar site which will probably pass the 30.000 unique visits after 3-4 months... And I dont want to try shared because most offshore plans oversell and I guess cant handle this kind of traffic

It's an act, not a law But I do see what you mean. We host many people who link to warez and don't have problems, but it's really up to you
Cameron, it is still illegal and you can and will be shut down if there is enough complaints. Napster was sued for millions for "linking" people together to download music from eachother. They never hosted any of the files. There are many cases like these that people get sued for. Warez linking is NOT allowed in the USA.
