Copy Tube Part from YouTube Logo

    Hi, is there anything wrong with me cutting out the Tube part from the Youtube logo and using it..
    Say i've got a site streaming some golf videos, and wanted to create a Golf Tube logo, can i use the Tube part??
    What's the risk, level of risk, and consequences?? If any of course..

    That is definitely risky - not to mention, I don't know the legality of using the word "Tube" for a video-related site! I'm sure someone here might know about that.

    If the red bubble with "tube" becomes part of your logo (not to mention how similar the entire "Golf Tube" logo would be), you're just asking for a cease & desist from Youtube.

    So the risk is you losing your site and/or paying out a settlement to Youtube... level of risk is high if you get caught... and Google/Youtube has deep enough pockets to really screw you over in court if it went that far.

    Yes, there are legal issues involved and you could be infringing the intellectual property rights of the owner. Could you please make sure that you obtain the consent of the owner of the materials before posting any of their materials?

    OK then, so it's a no from the red bubble with the word Tube, I will have to re-design the logo..

    Is it also risky to simply use the name Golf Tube? I can easily avoid this if it's a problem.. but the word tube is so common, i was wondering if it would be a problem..the site is video related and contains embedded youtube videos however!!

    wd: you should ask this question on Lawguru (it's a free legal advice site where real lawyers answer questions for free). I've asked these kinds of TM questions before, and got decent enough answers...albeit, not very elaborate.

    The word tube is common, but the use of the word "tube" when it comes to a video posting website is not so common. That's in Youtube's favor, legally speaking.

    You might be able to get away with it, but if it was me, I wouldn't use the name.

    the word tube is only in youtube because the tube is a name for tv. there's no way youtube would successfully be able to do anything if you use the word tube. But yeah - the logo can't use part of youtube's.

    You will be fine with using GOLF TUBE but not any part of there logo. I am pretty sure they have a trademark on that. If you are found guilty you will be responsible for all legal fees and on top of that they can take your profits from that company. Not worth the risk!!!

    Well there is nothing wrong in using the word tube along with Golf ! But using the half-logo can get you into trouble for sure. But still I have seen alot of people using it. Maybe Google will take action only if its a threat to Youtube itself !

    There is when the site is a video site like Youtube. Golf doesn't make it become a "separate business category" in this sense.
