If the blackhat method is illegal under your state/federal law then you have an issue. If it just breaks the TOS of a site all the site can do is ban you, there are no other legal repercussions.
That's why its called blackhat....its totally illegal. Laws may vary form country to country, but I do not know of any that have legalized it.

I fully disagree with you in every possible way. Blackhat isn't illegal. Certain, maybe most of blackhat's methods are in the rhelm of illegal. However, to group the entire blackhat persona into an illegal status would be a blunt misrepresentation of blackhat. Sometimes blackhat is more legal than whitehat. It all depends on the context and the deployment.. Blackhat is not illegal! You need ot make the difference between blackhat and fraud! Fraud is illegal not blackhat.
Fully disagree in every possible way.... Something cannot be more legal then another either. Blackhat is illegal in the sense that they attack networks. The person asking did not mention security testing, so I thought he was talking about hacking, and what he had in mind was illegal. Sorry for not being clear and I'll remeber what you said.
Fully disagree in every possible way.... The poster did not mention any specific blackhat meathod. Blackhat cannot be defined as it has several different levels and applications. I am quite sure the poster was asking about blackhat SEO (search engine optimization) which is not illegal. Most blackhat seo meathods are shortlived and not good for serious businesses.
A simple google search will yield what you are looking for. Most blackhatters never get caught. But if you are unlikely enough to get caught spamming or whatever method you are using, you could be slapped with a nice fine and probably jail time.
what I was going to say. Its like saying is doing things on the internet illegal? Very vague. CERTAIn things can be, but not all. And a lot of blackhat is NOT illegal in the sense you will go to jail. Most of it is just 'unethical' and usually the most that can happen is google de-index your site, or your ISP shuts down your internet. Jail time is unlikely. I guess it depends what you do, but if it is jail time it is probably more along the lines of pure spam and such, and not blackhat.
Not every form of blackhat is illegal. Just the spam part is. Using pagerank hijacking, google bowling, and all the other fun tricks isn't illegal - but it's really stupid to try and very unethical.
Spot on! Most blackhat methods would definately be described as unethical but not illegal. They may break the terms and conditions of g@@gle or other search engines/sites etc. but they are not illegal as in the police will be after you.
