Is music piracy now legal? I'm just wondering what's the difference between music sharing and music piracy.
Dpends which country you're from I suppose.. Think you will find its as illegal as it ever has been in the U.S :-p
Music piracy is not legal no matter what country you are in. In most places you will not be tried criminally for simply sharing files and not profiting from it. You can however be taken to civil court and sued for a large amount of money. Your place of residence can offer some protection particularly if they don't have relations with the US the primary creator of intellectual property. It is very unlikely you will be caught or taken to court for file sharing, just because millions upon millions of other people do it.
Why US government is tolerating a big company like Apple doing this illegal activity? Pod casting and Music sharing are both piracy
How is apple participating in piracy? Many podcasts are free to share and give away, and the ones that aren't are sold in the apple store. Apple also sells legitimate copies of music in their store. I think you need to check the definitions of music piracy.
It depends on the podcast, many podcasts are free so pirating them/sharing them is totally legal. If you have to pay for the podcast and you download it for free then yes that would be illegal.
Apple has rediculously strict TOS and I'm 100% this is covered. Something like "users are responsible for this and not us" will be written somewhere to cover them.
Music piracy is definitely illegal in most countries to protect the artist's rights - they need to make a prophet!
Apple is only strict in movie piracy. Since they release Ipod CD sales reduce almost 75%. I taught music piracy is now legal. Why google is not considering it like a crack? The biggest passenger ship in our country hit the center of the storm and our govt. said that since 2007 it's no longer the responsibility of the coast guard to monitor or tell the ship's captain about it. Our coast guard don't even have Global Maritime Distress Safety System (GMDSS).

If you do not have prior permission from the copyright holder of the music you are sharing to share it then it is illegal. People who create podcasts normally give permission for people to share their podcasts with other people, so would normally be legal, however music used within the podcast could potentially be used illegally which could make it illegal to distribute that pod cast. Still with me? If a pod cast uses completely original music or music that is "Pod safe" from something like the Pod Safe Music Network, it can be free distributed within the terms the creator of the podcast allows. No matter how you cut it sharing copyrighted works is illegal no matter what country you are in. It doesn't matter if it is music, movies, books or images. The difference is some countries enforce their laws with different severities. Many torrent sites have their servers hosted in Sweden because Sweden has no clear law that prevents people from hosting the .torrent file. They do however have laws against the piracy of intellectual property so individuals sharing files illegally are still liable.

Every age needs a prophet. I predict that copyright gray areas such as Apple iPod and YouTube will continue to be tolerated because they wield massive clout, while smaller sites and individuals will be harassed whenever they do the same thing.
I'm just wondering why not a single country has site of laws implemented. You can't use as your defense or excuse that you don't know its illegal. Laws are being change by the govt officials without telling the public about it.
