I would agree with that, I have no problem with adult content but I do not want my child to stumble across it.
Expect adult content on an arcade site? Eh no. I mean people shouldn't whine about it since it most likely didn't hurt him at all, but arcade sites are meant for kids.

Not that it makes a difference if her kid has access to the internet, he can download as many South Park episodes he likes through iTunes. Is she going to take iTunes to court? People can have whatever content they want on their website, the only people who can stop them is their webhost (if they have a policy against adult sites) and the government (if their content breaks the law and is hosted in a country which cares about the it). If I want to have adult arcade games on the same site which has normal arcade games, noone can stop me, if they try to, I'll tell them to go f*** themselves because I'm allowed to do that. It's always a good idea to have a disclaimer and in this case you could have just sent her the tos and that would be that. I have seen that for small issues also people outside there fire a lawsuit. Anyways, whatever happened you cant change that but make sure that in future to put the same disclosure in the beginning only which you put after sometime.
yes some people really go that far and file case on websites like his.... i forgot where i read it but i think i read a story that in California a woman drag a webmaster to the court for similar case... this can get really serious as many mothers dont understand that there kids dont follow rules writen on the website... all they know is there kids are seeing adult materials on that website.... normally man dont take this seriously but woman really take it too far.... i think he need to put something like age verification system.... this will help him provide proof in court that he did have age verification system to stop underage kids... but they keep breaking his TOS by entering fake age... then i am sure they will lost ther case
No, you only need to be 13 to use iTunes. I fail to see the real difference between a disclaimer on the header of a site in bold letters and the small print in the terms of use, infact, I would say a disclaimer on the header of the entire site is probably more effective as I'm more likely to read it. Yes, I'm going to tell the child protection society to go f*** themselves if they're seriously going to waste money trying to remove a website which has adult arcade games alongside normal arcade games when it already has a disclaimer and there's heaps of child pornography and other completely illegal material they should be targetting. there is alot of child protection societies in the world, that deal with abuse to things just like this, and they are more happy to sting you. He never had a disclaimer or TOS. And yes i do get offended by "adults" that swear 5 or 6 times with out air then again i have found its only Social rejects that act in such a manner. im not immature just Respectful for others. 13 to use iTunes but i bet you iTunes have a tos about 18 videos.
If you are a webmaster and used to the way things sometimes work on the internet then stuff like this doesn't bother you as you've pretty much seen it all before. If, on the other hand, you are a mother who knows very little about the internet and only want to find some harmless games for your young kid to play on the computer, you are going to take very badly to a bunch of adult games on a site that, from the mother's perspective, is aimed primarily at children.
