    I don't see why not... but that doesn't look like a 'background'. It's just an image above the ad.

    You should carefully check this with AdSense TOS as they have very strict rules concerning placing images near the ads.

    I too had noticed the same and not yet exactly know under what conditions it is allowed.

    is a site that are selling different image like is owners call it like that all i want to know is for sure i can use it on adsense

    Putting images, HTML headings (<h1>, <h2> etc), bold text and any caption other than "Advertisement" or "Sponsored links" right above the ads is forbidden by the Adsense TOS...

    This is definitely not allowed. Too much attention on those ads.
    You can always email the AdSense team and ask them but I think the answer would be NO ;)
