Using e.g. a TV Show or Movie to Promote Offers

    I was just wondering, there are sites such as American Idol fansites etc which generate income from the traffic they receive. Can you promote ringtones generically, but then have an American Idol banner on your page? Or could you promote "American Idol Ringtones" or is this considered illegal.

    Yes and no... technically you shouldn't use their banners, but I have seen other affiliates use TM logos/banners on their sites (as well as I do it myself :) ).

    You can bid on the term 'American Idol', but the text within your ad will need to say 'America Idol' (which is not a TM term)

    If you still feel scared and don't think you have enough in your affiliate check to cover the big boys at American Idol suing you... you can put a disclaimer at the bottom of your site saying that the banner is the intellectual property of American Idol... your site is not affiliated with American Idol, blah, blah, blah... you get the point

    So I guess putting pics of Simon, Paula and Randy would be a no-no (unless I want my brokeass sued)?

    Hahaha... I used to promote American Idol ringtones a couple months ago and put pictures of all 3 judges, pics of the contestants, etc. on my site. I wouldn't worry about getting sued.

    The keyword people should remember before promoting american idol ringtones is "used to promote" meaning it doesn't make money :)

    LOL, If that's the case, then pretty much anything goes then. I would have thought FOX would tear you a new one if you got caught using their goods :)

    Damn, way to crush my dreams of promoting Idol ringtones! ;) Especially since it would be the perfect time to start a new Idol campaign just days before the finalist is chosen. Guess I can kiss my $5000/day idea goodbye :p

    Boy, you guys are smart! :D

    Actually, I only promoted those American Idol keywords for about a week or two... and never tweeked it in my ad groups.

    As I recall, it pretty much broke even for me a few months ago, but I was able to eek a little profit out it... so I'm sure someone with a little more fortitude than me can make it work :cool:

    Nor would they ask publicly in a forum whether they should promote that certain offer or not (AI was just an example for those razor sharp readers out there) :D
