Sounds like a link farm if you ask me, no natrual website would contain 30-40 links in the footer beyond attempting to manipulate search results by link exchanges or other link schemes. Remove the links and start building natural relevant backlinks.
If these are links to other sites then you should reduce the number to 5 or 6. If they are just internal links to other pages of your site then you still might want to reduce the amount to maybe 20 at the most. I have seen internal footer links have a good effect for search engine rankings.
Footer links are the least valuable links when it comes to internal linking structure. They should appear inside of content and within a menu bar that appears above or under content when viewed with a GoogleBot spoofer.

How much value they have exactly I don't know but I do know that I have seen rankings improve when they are used.
I think the key isn't to try and walk the line between what is acceptable/not. Instead, create a better user experience and you won't have to worry about being penalized. There are other strategies to attain high rankings - those footer links shouldn't be the deal breaker.
Very true, and i have noticed this Pagerank update they took a bigger hit then last update. Many footer links remain without PR, example the "Library" link in the footer of DP to the archive is PR N/A yet it's linked from every page on the site including the PR7 homepage. On the other hand the FAQ/Rules up in the navbar that's linked from all the same pages is PR6 which is normal. It's obviously Google's attempt to devalue things like Wordpress sponsorship links and general link selling.
