My mind crashed four days ago! I created a beautiful wordpress theme (it was uncoded) and started a thread at the buy, sell or trade template selection saying that it's for sale. The one was pretty special and in less than a day I got more than 15 responses (all of them were bids). That was because I set the starting price to $0.5! The last one offered me 15$ and I accepted the offer. He said that he doesn't has a paypal account so I was waiting for it about 1 day. The next day he paid me and I sent him the psd via email. After that he told me that he haven't received the theme  I went to my sent folder and saw that I sent him the theme. After that I sent him a pm saying the title of the email and told him to check his spam folder too. No way!!!! I got him on gtalk (after 3 days) and sent him the psd file. When he saw that he was kinda confused, and said - Psd ??? this guy didn't readied my post at all! He thought that It's a ready theme and that he could use it on his blog without any coding. loool! I told him to look for a coder and post there. The next day I received an email saying that he wants a refund. Hmm. No way I am gonna send him hes money back sense he got my psd - my work. I don't have any guarantee that he deleted it from he's computer and don't think of giving him the money as I see many people getting scammed here. It isn't the 15$ but after all my work, and time spent for he's "fucking around" there is no way I would give him he's money back  So this means - "no refunds, happy life"! I am sending him a PM now.

Obviously the guy was confused and thought that he was buying a WP ready theme, did you try and make it clear that the theme was not ready and wasn't functioning ? I too would fall for that and think that I was buying a ready theme.

I clearly told that the theme is uncoded but lets say that you are saying the theme is ready for use and don't provide a live demo. Would that fit? I told him that the theme is uncoded and the fact that he didn't readied my post is another thing.

I would send him his money back. If someone writes a check to Joe's Garage to buy a tire when they don't sell tires means Joe's needs to send the money back. Even though it's not Joe's fault.

Ok? Just calm down now. Don't give him his money back if that's what you think. You have the right to decide!

I won't give him "my money" back because he has the psd and because of the thing that he has the psd I have my money.

chill dude... these things happen. It's up to you if you want to give his money back. But then again, you can always sell the template again to someone else who has better use for it. Chances are, even if this guy has your psd, he can't really do much with it.......considering he doesn't know coding.

And if the template really is professional, I'm sure you won't have much trouble producing more high quality templates to sell in the future :)

    Good luck!

he could resell it even tho he cant use it so keep the money. if nothing else he has learned a lesson and it could have been worse.

In the future I would recomend explaining in the thread that they are simply purchasing a .psd file and not a ready theme. The phrase "the theme is uncoded" may not make sense to everyone as most people only buy themes when they are ready made. As far as the refund goes, use your best discretion, I'd give the money back personally as I doubt hes going to do anything with the file but its your choice in the end.

Were you selling him the rights to your work? For example once he'd bought it only he could use it. Or were you keeping the right to use the design even though he'd bought it?

I couldn't agree with you more. I won't OUT the alleged "coder" I hired from this DP site, that obviously isn't as proficient as he proclaims, but when he said he'd get it done, he ignores me when the issues are ones he personally doesn't know how to fix. Considering the price I paid, and the overall completeness, I was duped. I emailed him asking for a partial refund, since he promised it would be to my satisfaction, and now even two months later, there are still several LARGE ISSUES with the coding. Beware of some of the so called "professionals" on this board. If he's reading this, "FIX IT, OR REFUND IT."

A little excited about $15 bucks, but it is very simple on what you need to do.

If you do not care what he may say publicly about your service or company than keep it the money. He bought it, you gave it to him, no warranty, end of story. However, if you do care about what he says about your company, then simply return the money. Returning money is a common practice among most retailers because they know giving good customer service can be their best marketing. There are plenty of scammers on the net, but there are fewer than you think.

It's clear from your thread that it's uncoded: http://forums.digitalpoint.com/showthread.php?t=781318

Personally I have a problem with the concept of "uncoded templates" as they're really only "designs".
That template would work as well for Joomla, SilverStripe, cakePHP or any system.
It's only a WordPress theme once it's coded.

If the buyer had done due diligence and clarified what the sale was this situation wouldn't have occurred.
