I was selling my eBook on SitePoint and was trying to sell to this man. He kept coming up with excuse after excuse to lower the price. Im not in a good state of mind at the moment so I was doing whatever so I could get money to buy a plane ticket. When the price was settled he made the bid on my SP auction and then today he made the escrow proposal but hasnt paid escrow.com yet. A few hours after that he comes up with yet another excuse and now wants to pull out and not pay at all. He wasted 3-4 days of my time and tries to pull this... sigh. Since SP auctions and bids are now legally binding what can I do if he in fact doesnt pay? I am legally able to sue him, correct?
These things happen all the time, sueing will probably cost you more than you gain from it. I would count my losses and put it up for sale again.
I would normally just brush it off. This guy is a royal douche bag and since they are legally binding now I dont care if it costs more. I dont pay for our lawyers, my parents do.
Then go after him! I hate people that make a deal then back out. He deserves more aggravation then you had to deal with... Good luck
Since Site Point bids are legally binding that means, by law, he has to pay me if he made the bid. Escrow is just for the payment and transfer.
He's made a contract by winning your site. If he doesn't want to pay, you can pursue him for damages for breaching his contract. Of course it depends how much the site was worth in the first place whether or not you go after him.
It is an ebook, I don't quite think an ebook sells for as much as court fees. Unless of course you are selling all of the rights and the whole shi-bang.
Your parents pay for your lawyers. First I if you are below the age of 18, I don't think you can enter into a contract with another party. That is the first thing I would ask your lawyer. Also, yes you could possibly sue for backing out *but* would you sue someone at the local flea market for haggling over a price of an item then walking away saying they don't want it. Sure you would get pist and time has been wasted. If they don't have your domain, website, or files then brush yourself off, take a breather, and go resell it.
