I live in Michigan and I was going into my local Walgreens store to make a purchase, and suddenly, the clerk told me I had to leave my skateboard behind her desk, do my shopping, then retrieve my skateboard after purchasing my products. I just wanted to know, is it is legal for a store to confinscate one's property upon entering a store?
Yes, I did. Well, I guess the question is Is it legal for them to not allow me to shop at their store if i choose not to give up my skateboard?
i would say no, unless there is a sign that specifically says no skateboards in store. But ofcorse they probably would make you leave if they didn't take it because you could do damage to yourself, the store, and other customers so it would be best just to leave it out of the store
That is a good point. But, items such as carts could also do damage to the store and other customers. I find it irritating that a store can overlook a cart on wheels but prejudge my responsibility of handling a skateboard on wheels.
Maybe you should drop Geoff Rowley an e-mail and ask him I know as a skateboarder in my early teens we were forever getting banned from shops for skating inside. There's just somethin' so good and smooth about supermarkets' floors that it's difficult not to be too tempted, huh
You're the kind of people that give us real skaters a bad reputation. Why on Earth would I want to skate in a supermarket? That's one of the dumbest ideas I've ever heard. And Geoff Rowley? Come on man. What are we in the year 2000? I posted this topic for legal advice not for a converstion about my hobby.
With some exceptions stores and malls can make whatever rules they want. It's private property. My local Walgreens and supermarket are across the street from a high school. At lunch time they have a guard at the front door. Teens have to leave their backpacks at the door, the guard collects their school IDs and gives them back when they leave. It has cut way back on trouble and shoplifting.
Ill make nice and simple for you. Yes it is legal. And if you refuse, they have the right to refuse access to the store. Mystery solved.
If it is a consistently applied policy, I do not think it violates any law. However, if they singled you out and let others enter with a skateboard, then it might be a violation. The simply reality is that they did not confiscate anything. They told you to enter you had to hand over your board. You chose to agree to those terms and enter. You could just as easily have taken your business elsewhere.
Heck...if they offered to hold my deck I would be grateful I didn't have to carry it around the store while I shopped.
Maybe they didn't want you to actually skate in the store. (who knows maybe there was an accident before). If this is the case you could promiss not to skate there. You could always negotiate. Also, maybe they don't want your skateboard in the shopping cart. At the end the store is someone's property. They could set up rules just like you can on yours.
