My host is ignoring me and refusing to give backups.. is it legal?

    My host has been ignoring me for the past 2 days and refuses to give me backups of my files.. is it legal to do this? What can i do!?

    I've got no backups on my PC the last one i have is from Dec 06.. Help is appreciated.

    no it is not legit.
    good hosting providers need to give either backup or access to your cp to do backup.
    unless its free hosting you will be charged for backup.

    try submitting more tickets or contact someone via pm if on here.

    I've sent emails only to get responses promising more then i got.. tried IMing but goes offline as soon as I add him to MSN/yahoo/aim

    Its not a free host and I have given this guy over 6 customers since he has always been good till now. Theres no more ways i can contact him that i havent done already

    what backup? maybe it is not refuse, but can not give? can not give bcoz your host never make backup of your data?

    I do not think there is much you can do more than keep on trying and hoping that soon he will send you a backup. As soon as you have that you perhaps should start considering a new host...?

    Read their terms.. it could be that they're not required to give backups.

    Eek, If any host had terms like that, then that's a HUGE warning sign!

    Also, Joe, do you still have access to the hosting? you may be able to create your own backups if you do :cool:

    why? no need to have any statement about backup. backup is natural task of customer. if host does too it nice. if not it not his problem.
    much bigger warning sign: 99.99% uptime garantee. nobody can make such garantee for low money. and when they say garantee what heappens if not 99.99% uptime? all money back? 5 extra days of free hosting? nobody makes statement on that so far.

    I don't think you understood.

    If a host has in their TOS that they don't give backups then that is a huge warning sign.

    I think you not understand.
    If backup is not mention in TOS what then?
    if they say "make your own backups or bust" then they speaking honest. if they say nothing about backup they simple want you not to think. and they dont do backups most then. but customer will only assume that host makes backup.
    my host makes backup of complete server each night. guess? i do pay for this service. I can also say "no thx" and save money. but then i need to make my own backups and restore is also my duty then

    No, I'm gonna have to agree with cameron: I don't think YOU understand.
    The host has backups, they're just refusing to hand them out.
    Yes, I have been in this situation before (with hostgator even), but sadly there's not much you can do.

    reading in hosting forum shows that many supercheap sellers not have backups any! or make backup on same hardisk where data is. and which law says that host has to hand over backups? and which law says that he has to make backups?

    i'm with exactly the same problem!!! my hosting dont want to give my backup,they have suspended my account for no reason and dont want to give me my files! whats your hosting? maybe is the same hotsting that i'm using! :eek:

    Well it was awesome timing.. i FINALLY got my backups and my new host decided to turn me off while i just had a temporary page sitting there.

    There is no TOS since theres no website. And dont assume i am hosting illegal files.

    1) VPS host blocked me out so i moved to a reseller account
    2) Reseller account suspended my site while i only had 1 page on it.

    and i have no idea.. the second host said i was being ddos attacked but who the hell doesnt have protection against that
