I need some advice on what to do. A company pretty much scammed me.

    A company by the name of Pow Web has a 30-Day Money-Back Guarantee.
    I purchased a years hosting for the sum of 70$ (Can't think of the exact figure)
    Anyways, I wasn't satisfied after about a day of their "Not wanting to help" attitude.
    Long story short I asked for a refund after 2 days. They keep saying they will refund me after 3 business days - it's now two weeks later.
    I have excripts of the conversation I have had with them Via Live Chat.
    I have paypal proof I paid them. I have some other stuff that will help my case.

    Now the question remains.
    "What do I do to go about suing - getting my refund?"

    Thanks in advance for anything you contribute.

    Well, you may be screwed. Depending on where you are and where they are you may have no worthwhile recourse. If you are in the US, the only thing you can do for such a small amount is to file in small claims court (which could cost more than the $70 depending on the state you are in). If you win, in many states they will have to pay the filing costs that you laid out initially for the claim (but you still have to fork up the cash first). Of course, that is assuming that their business is in the same state as you are. If they are in a different state, it depends on that state's laws. Many states will require you to file in the state of the business (so a possible trip or flight to a different state). If they are out of the country then there is whole different mess.

    What you can do is call them again and say that you are not happy with the timeframe of the refund and you will file a complaint with the BBB if the matter is not resolved promptly (again, assuming they are in the US as well). You may also say that if the matter is not resolved you will post your experience on consumer affairs sites and hosting forums. None of that has a lot of legal strength to it, but they might get off their @$$es over it (or might not).

    If you have been scammed and you have used Paypal, then you may be able to do a charge back to the company and regain your funds by opening a dispute using Paypal's system:

    The same is true of most major credit cards as well. They may or may not help in this situation as the 'goods' were delivered (by goods I mean hosting), so they may not get into a refund dispute, but it doesn't hurt to try. Should have thought of that earlier. Paypal may or may not help because they may consider it a non-tangible good (and again, it is a refund dispute).

    I had a similar experience with lunarpages would you believe. I contacted them directly many times with my paypal transaction id and they just kept saying they still hadn't received payment (which was bs). Anyhow I filed a charge back through paypal and after a few days got my money back.

    It's worth a shot. Just make sure you provide paypal with as much info as possible to prove your case.

    Paypal doesn't do chargebacks..credit card companies do. Paypal only recieves notice of the chargeback and if it's not fought properly they have no choice but to refund. That's standard business practice.

    You can obviously can start paypal dispute against the company since if you have done payment via paypal, along with if possible try to search out organization might help you in this since the amount is not too big else I would have proposed for better business bureau

    Make sure others don't have the same problem :)

    If you were in the UK I would recommend reporting them to Trading Standards; perhaps there is a similar Canadian organisation?

    I once designed a whole website for someone they paid me i gave them the files

    everything okay right??

    they opend a dispute and all of sudden they got their money back and they ran off with my work...

    paypal wouldnt even listen to me..

    contracts are key.. if u dont use them.. then you are setting your self up to crash..
