I am starting a Indian song site.I am giving direct free mp3 songs download But recently i seen in a news that this is not legal So guys please help me. I have setup everything (hosting,domain,advertising) so i cannot drop this idea If this is illegal then please suggest me a other way.
I dont think there is another way round it your stealing other artists tracks & your also encouraging other people to do it by giving the tracks away. There are some legal sites where they charge per album or something like that, such as itunes, so you could always look into how that can be done legally. You may have to change your plans slightly , but other than that you'd have no choice but to drop it.
I will suggest you to drop the idea of providing free MP3...and continue only with lyrics, latest movies revies and promo.
Raaga and chennaionline dot com are legally selling songs. Look for a tieup with license holders. If you offer free MP3 downloads there is a high chance you might be asked to shut down your site.
And guys what about warez-hosting for the mp3 site???? Can he change the hosting and continue his plans by spending more money?
Banned from where ? Also i have seen many sites which provides free song downloads then why didnt they shutted down ? I cannot answer you hope u get answers from our DP experts
I saw many sites offering free MP3 downloads.Don't know if they are legal or not.But if it is illegal then you better try other way.I saw India have strict law for online stuffs.So you have to be serious.
but what the warez hosting exactly is for ?? Because warez sites are offering illegal software same as illegal mp3.
You just found out that sharing copyright protected materials is illegal? 0.o But I know enough websites for MP3 downloading and they're still going... what you could do is one of the fallowing things: A. - You can have your website hosted anywhere as long as you will host the MP3s on public file hosting services (like rapidshare, filefront, etc etc)... then you can claim in your Disclaimer that you are not hosting any illegal material yourself, and your website is just a links sharing website... B. - You can host your website and MP3s on a dedicated server belonging to a company that allows this kind of hosting... tbh dunno where to find them... look closely in ToS... cos some can specify stuff like: "once your server is ready and login handed to you, it's your responsibility what you host on it and what you use it for" or some stuff like that which basically states that they aren't responsible for any sh!t that you will do with their server... Anyway... good luck...
Rubbish lol, what that means is your responsible for your own actions, it doesnt necessarily mean, fine go ahead and put any illegal stuff you want on our server, if they specify they are a warez host then they obviously won't care. Also hosting the files elsewhere on somewhere like rapidshare doesn't make it right This of course doesn't mean the warez host themselves can't be shut down by their providers, perhaps they are breaking the tos of their providers? for hosting any illegal software etc, even warez hosts will have some sort of rules about what you can't host their, but I doubt many will do much to enforce these rules.
If you can buy the rights of downloading from net from the songs owner,you can go on your plan. Good luck.
