TradeMarks Issue

    Hi,

    I wonder when someone say their violated the trademark issue such as movie/music download sites, does it mean that they cannot bid of the keywords or the URL of the site contact the keywords?

    How about keywords like iphone? Can you bid on this keyword?

    google doesnt allow for trademarked terms to be bid on. these are legal issues that google prevents by incorporating the trademark infringment validation during keyword selection and creation.

    Bullshit. You can bid on TM term, you just can't include some TM kws in your ad copy.

    It is only a matter of time before Google identifies that kw as infringing on trademarks before they make it inactive.

    Call Google yourself and ask if you are able to bid on TM terms. See what they tell you. 866.2.GOOGLE

    YES you are allowed to bid on trademarks

    NO you cannot place the trademark in your ad.

    Its yahoo that does not allow trademark bidding

    Yet for some reason across 10 accounts I never had a problem with bidding on TM terms and my account manager never mentioned anything either.

    But hey, some dipshit on DP said so and he's got Pro in his handle, so it must be true. Continue to enlighten us please.

    You still have to be careful, we had a client who got sued last year by the manufacturer because he kept on wanting to bid on manufacturer terms. The manufacturer won... so just because Google wont turn it off, it doesn't mean that the law is on your side.

    I tried to put "tiger" inside one of my ads... didnt allow it so I put "tigers" instead... is it also violating a trademark??
    geez, but who trademarks the word "tiger"? its like putting a trademark on an apostrophe...
    people are crazy todays...

    You have a point but some advertisers are fanatic about their brandname, especially if they run an affiliate program as well as their own in-house search campaign.

    In the case you mentioned simply ask for an exception. If you've got a valid case (rather than trying to run a scam), Google usually approves this after several days become some trademarks have double meaning (tiger) while others don't (iphone).

    but they allow me to use "tigers" right away (it doesnt complain) but im afraid that if they see that its a plural of "tiger" (a trademark) they`ll do something stupid like suspending my account again...

    You can bid on trademark terms just don't put them in your adcopy... Trust me YOU CAN BID ON TRADEMARK terms. I have never had an issue with it..... No misrepresentation is a whole different ballgame but bidding on the terms is fully legit and competitors do it all the time.
