You should write the web site owners and ask permission to use the images (photos). A general rule is that copyright resides with the image owner whether or not a copyright notice is included.

No, everything is automatically copyrighted unless it explicitly says otherwise, there is no need for them to say that it is

    Can you? Yes
    Should you? No

Whether you are legally able to use any of pictures are not decided by anyone in the forum. You will need to write in to the copyright owner for explicit permissions to use them. Even if any forum members tell you that you can use it is of no defense in a court of law because you are asking the wrong party. Also ignorance of the law is not a defense in court.

No... how are you confused?? If the copyright owner says "you are free to use my pictures" you can use them, if they dont say that then by default you cannot.

You must remember to ask the copyright owner however who may not be the website owner - my friend who is a photographer makes a lot of good money from people asking the wrong person to use his photos.

Think it is more to do with fairly unintelligent models that dont understand what rights they have on the photos and magazines that dont care much either as the contract between the magazine and the supplier of the photo says it the supplier will indemnify them against IP claims and yet as far as he knows not one of the models have been approached to repay the money.
