Did we ever confirm if this "image behind the Adsense" trick is within the Google TOS?

    Same question.

I would like to see a reply from the adsense rep(s) about this.

If anyone does decide to contact them, make sure to send me a picture of the image you are referring to, so they get a clear picture (hopefully) of what you mean....

    Hello,
I hope there is not problem to use it, because you are not updating the Adsense code, it is like you use a background in your whole page :)

    Best,
    Jakomo

The fact that you are not "updating" the Adsense code isn't the issue. It's also against TOS to place images in close proximity to the ads, which is not changing the code either. This background technique will probably fall into the TOS category of placing ads too close to images.

I'm not sure if all this is allowed. In my opinion you should ask the Google AdSense Team before bringing so much attention to your ads.
Sure I can put a nice girl's photo as a background of my ads and this will skyrocket my CTR, but I will be banned in no time.

Someone must ask Google... :) Everything else is not sure...

Yup..I can't figure a way around it. Google Ads close to images = TOS Violation. It's unfortunate, but that's how I interpret the rules in this instance.
