I am going through small claims court or a class action case, I lost $3000 from Adsense already, so I have nothing to loose by trying. If you want to join a class action case please PM me, it will be stronger for us all.

ps. please read the T&C you agreed to when you signed up with Adsense. No lawyer in his right mind will waste his time on this.

I am afraid you have a lot to lose by trying, do you know how much legal fees is involved? 10x? 100x your $3000 easily if you want a class action.

Also how did you lose $3000 from Adsense? They banned you? On what grounds?

$3000 is a lot of money, I can imagine the anger and frustrations. But Adsense does not ban anyone out of the blue. Everytime they ban, they will have to refund the advertising fees back to the advertisers, imagine $3000, they could have easily refund $10 000 or more back to the advertisers. It is a Lose Lose situation.

Clearly on such an accord, they won't ban you unless they absolutely have to.

Just like no lawyer in his right mind would waste his time on a class action lawsuit against microsoft for a single weekend of xbox live downtime, huh?

After all that I've read about adsense I'm starting to think that this might not be an impossibility. I may be mistaken, but I believe that are several companies that have been sued (and paid out) over things covered by umbrella tos's.

I'm not saying you'd win, or that it would even be worth the time, just that it's not a ridiculous proposal.

But on what basis is the lawsuit about? The OP is claiming to go to small claims on one hand and a class action on the other. Both are near extreme ends of the spectrum.

The best thing to do is never have just the one site and never use just the one program to earn from. Always have more than one egg and always spread them eggs out into more than just the one basket.

My Adwords account has been credited before because some of the clicks I paid for were deemed fraudulent.

their new TOS says they OWN your site pretty much (share your site name and info, install cookies, etc)and can make any decision they want. you can go to the court but you are not getting a penny from adsense going to court, thats for sure. and no legal farm in the country will take a class action suit against google reading the TOS they have

This is great. IF you actually win the case google will go down! Everyone will make a new adsense account get it banned and join the case.

Whether or not you succeed will depend on if you violated the TOS and Policies or not. If you were an innocent victim of Google banning you for the fun of it, then i hope to god that you win.

However, if you violated the policies/TOS, and got banned, then applause to Google for protecting their advertisers.

So my question is, why did you get banned? Do you think it might have been for spamming Craigslist, like THIS or THIS ? Or was it for some other violation that you did?

And, as for "have nothing to loose" - I would check with your attorney. It is quite possible that Google could counter-sue you to recoup their legal fees, etc.. and i'm guessing that Google's army of lawyers is not cheap.

anyway - good luck to you. You should start a blog to chronicle your progress.

Big companies like Google normally would have a legal department, they don't really need to spend extra on hiring outsider lawyers. I guess to them it is a cost that is already factored in.
