    The last time congress declared war was against Germany in 1941, Two its hard to officially declare war against a guy in a cave with about 10,000 followers and no country of base.

    Three I think your talking about the 4th Amendment, and since when did the US constitution becomes the world's constitution?

    Where has it been exposed that Bush was doing domestic spying prior to 9/11

    That's the way our government is designed. Congress declares it, funds it, and then its run under the command of our President. You can't just skip to step 2.

    In 1973 Congress passed the wars Power Resolution which requires the president to obtain either a declaration of war or a resolution authorizing the use of force from congress.

    September 2001 Joint Resolution 23, the "Authorization for Use of Military Force."

    Hence your declaration of war. Therefore step 2 war never skipped.
