If there similar go for it it won't hurt you. But in terms of SEO it might not help you too much if your using the same ip but you will still get to trade traffic with your self.

It shouldnt hurt your ranking as long as the sites are relevant and not on the same server or ip class block as far as I know.
yes yuo can. it would be better if both sites are on different class C IP, but even if they are on same hosting account - it doesn't hurt.
Links coming from the same IP not counting is mostly a myth IMO, especially in your case we are just talking two sites. Maybe if you have dozens of links coming from the same IP it could trigger some sort of filter but just a few won't matter.
Google TOS is not part of the U.S. or any other country's legal code. A good rule of thumb is link if it makes sense. Linking to another website you own seems like something a person would do even if they knew nothing about SEO.
