Smaller images copyrights

One site making small thumbnails from others (40-50px). I need some to my project - is there copyright restriction on small images? Is there something like in music industry there song becomes freely available after 50 years from time it was written.

Also I can do those thumbnails myself since they used freely available information to be created. (just want to save some time)

    1.
    above all
freely available means in NO way free of copyright protection.

    2.
for all the rest common global copyright protection is valid. take your time to study international copyright law before attempting to earn money from other people's work.

    3.
as a preferred option / alternative:
use the only method that always keeps you free from doubts and troubles - create content on your own. publishing your own creations brings you INFINITELY more satisfaction and reward than any copied content from other creators ever could do.

Thanks for suggestion! But I do not plan to earn directly from the project / pictures etc. - just doing research how Google reacts on particular sites' structures and to prevent ban have to show site has graphic content also.

    Any other opinions / information?

I don't think the images will be copyrighted if they are available as public domain.

I guess it's better to consult with the site themselves.

if pictures are declared by law as public domain or by its creator ..

but many sites offering pics are stolen and such sites often declare that their pics are public domain.
to be sure you HAVE to ask the CREATOR or pics whether his pics are PD or not. thieves always say yes - hence you have to verify whether the one saying so IS de facto owner of all rights or just pretends to be owner.

in addition you have to consider that pics that are already published one single times in the web automatically become double content PD or not - and the second one to publish double content may then be the one banned for publishing double content.

there are HUGE sites with ten thousands or more pics or graphic content out there offering "free" wallpapers and pics of all kinds - all stolen and yet declared free. public domain has nothing to do with free but often free is falsely /believed/considered public domain.

it always is most questionable to publish any content OTHER than SELF-created and any testing of the kind you mention also can/could be done with self created content.

    Thanks for the clarification hans.
    Hope this helped the OP.

I guess your perspective is entirely different from mine but more accurate in this case.

Thanks, Hans - pretty good explanation.

    But situation is (example)

    http://www.screenalicious.com/page1.html

These thubnails - are they property of screenalicious ? If I'll do screenshots myself - they will be exactly the same. And I asked exactly about screenshots - not some kind of art content like photos or illustrations - just screenshots.

I guess you can take those screenshots in case a dispute arises claim that you took the screenshots yourself :p
Not a perfect solution, but nevertheless it should stand up to enquiry.

It makes no difference whether you intend to earn directly from money or not, if the images are copyrighted to someone else then you are breaking the law (there are some exemptions for private research/study, but I'm not sure those would cover uploading them to a website).

The screenshots are *not* property of Screenalicio.us - the copyright design will generally belong to the site owner (or possibly someone else if they've used a free web template). I doubt anyone would sue them for using the screenshots but any copyright owner could ask for their sites to be removed from that site.
