There doesnt need to be a lisence for you to sue. When i buy chocolate from the shop there is no lisence but i could still sue. I am a law student. A contract exists when off and acceptence has taken place. He accepted the offer when downloading the template, therefore has breached the contract. It would never go to court, I doubt a judge would waste time over template links....
No but a letter to his house from your solicitor may help things along. At the end of the day he has stolen your theme. Get in touch with his web host.

As already pointed out, hosts are probably the best people to contact, if their reputeable and care about what goes on with regards to what their customers get up to. With regards to legal action against another, most wont bother with a solicitor as it makes no sense if the cost for the services against what has happend outweighs any solution.
