Is uploading Videos and Music illegal?

    Hi,

    I'm starting a new video/music site soon and won't be taking any videos off youtube.

    But what I want to know is can I actually do this.

    Is it illegal to let people upload music and videos they have onto my site?

    All posts will be greatly appreciated!

    Yes read about the DMCA and safe harbor laws.

    They will only apply to you if:
    - you remove any infringing material as soon as you are alerted
    - your sites primary purpose is not for uploading copyright material
    - you make your uploaders agree not to upload any infringing material and state that if they do they are breaking both the law and your website's terms and conditions.

    Even if you do this you could still be targeted by a lawsuit - YouTube is in a $1 billion dollar lawsuit with Viacom over copyright infringement.

    No matter how many warnings you put on your site warning your users not to upload copyrighted music/videos, the fact is, people will still do it. With this kind of website you are always going to be risking breaking the law, even if you dont mean to.

    I don't know if it is illegal.

    I upload videos from YouTube and other sites on occasion. I give the site full credit, of course.

    If I were to get an e-mail from them telling me to take down a video put up by Joe Schmo, I would tell them to send me the paperwork with his signature on it saying he sold his property, video, to YouTube.

    If they wanted to sue me, go ahead. I'd welcome it. I could use the free publicity.

    Now, if Joe told me to take it down, I would. Not because I was breaking any laws, because I don't know if any has been broken, I would do it because it would be the right thing to do.

    Yea, I'm going to state that they can't post any material that is copyrighted.
    And a link on the page saying: If there any problems with copyrighted materials please contact me and I'll remove it asap.

    I always look at AllSP.com and read is disclaimer and just cant find the fault in his reasoning. So just find the movies on YouTube try not to upload them your self if you know you dont own the copyright's

    I don't believe it is illegal but it is a road that will always have some major bumps in it. So be careful and alert at all times.

    I have a friend do the same thing as you..he developed a site like Youtube..it's not illegal at all..because it's not you upload that kind of video right..so you need to stick the uploading rules before someone upload any videos..you have that right to do it..am I right?;)
