FileHosting Site, can get me into trouble?

I was planning to start a file hosting website. I wanted to ask that what are the risks involved in it. If i have a TOS like rapidshare in my site, and someone uploads w*rez files to it, what *can* happen to me?

First thing you do is to check with your web host if they are okay with what you do.

Typically if you get reports about a warez being uploaded then respond promptly and delete the offending file.

Well, this will largely depend on what you allow your users to do, and a ToS wouldn't really offer much protection if someone decides to take legal action. Your main concern would be with copyrighted material being uploaded to your server.

Your best bet would be to comply to the safe harbor protection of the DMCA. Register a DMCA agent with the US copyright office and take the necessary steps to remove copyrighted content from your server. That way you will be protected from liability for the actions of your users.

well some file host ask for dcmas to report and others just delete them directly

its betta to delete reported files but offcourse check the file before deleting sometimes reported files are fakely reported

After this, I think its better to think of some other idea :p rather than starting a file host :)

i have a server (AMD dual core) with 2gb ram from softlayer. I was planning to buy a VPS with 10mbps unmetered from somewhere to prevent excessive bandwidth usage for this site. Still looking for a script...

dont have a budget as fixed yet. A reliable VPS would be nice (and not too expensive like LQ)

what kind of script would you guys recommend that allows members to purchase premium upload accounts? so if you buy one plan, you get 5gb of upload, etc?
