I think it doesn't comply with AdSense TOS because it was mentioned that any trials to give more attention to the ads might get you banned.

Imges are to close to ads also. This little triangle is also image so it's against TOS, but i must say that it's looking nice About year ago I was testing images close to ads, everybody was doing this "trick" then. I haven't noticed that my CTR increased. I removed images and CTR was still the same - very low. At this website ads were so bad targeted that nothing could help them
Yep, I'd say this is a pretty clear cut violation of the tos. It looks good, but it will eventually backfire.
It does look very nice but editing the code is not allowed like others pointed out. If he makes that a 160x600 it could be allowed but the only way to know is to ask Google themselves.
