Bought a data cable on eBay

    Slightly different issue here, but it is business related and it is a legal issue :)

    I bought a data cable on eBay to unlock my mobile phone.
    It didn't work. The seller asked me to send it back with the phone and he'd unlock it with special equipment.
    He did that and kept the cable. So I ended up with 1 unlocked phone and no cable. (I had originally intended to unlock a few phones.

    I said this via email:

    And he's hit me with this, which was on the auction listing:

    I smell a rat. Can he do this?
    The 'we will do it on site for you for free' must be false as it wasn't free at all. I had paid for the lead.

    I'm a bit baffled. Can you please help me pick his argument apart and help me form the perfect comeback?

    Email him telling him you paid for the cable not him unlocking your phone. You want what you paid for a cable to unlock cell phones.

    Well you could highlight to him/her the word "FREE" which would mean he/she has to return back you r money in exchange for the cables, eventhough he did not mentioned about refund for unlocking your phone onsite but he/she did used the term "FREE" which one would assume a refund

    Well since you paid for the cable and HE offered to unlock your phone your in the clear.

    he however, is not.

    If that was mentioned in the auction then he technically did not do anything wrong. He clearly stated what would happen and that's exactly what he did.

    What was stated on the ebay auction page? If everything he said in the email was stated on that page he would not be at fault. However, if all that was not on the page you may be able to argue against him.

    I would file a dispute with ebay, and if you paid with paypal file a dispute there as well. That way, he will either have to refund you, or send you the cable and resolve the problem

    not in the UK anyway.
    The way I see it, I paid for a data cable, and that's what I should have got.
    And I agree that the term 'FREE' was used in a misleading way.

    He's saying here that he will unlock your phone for free if the cable doesn't work and you have to return the cable. I would assume from this that he would refund the cable price since it was of no use for you. I know he is implying that you must trade in the cable for the unlocking service but his wording doesn't make that clear. I would state that to ebay in your dispute that it was your understanding that the unlocking of your phone was actually free since the cable didn't work. I hope it works out for you but from my experience, ebay usually sides with the seller.

    I'll email him stating that, asking for at least a partial refund before going to eBay.

    if it was me, yeah ;) Beside he did say free not in exchange for them doing the unlocking. He needs to explain why he say for free when clearly he keep the cable which has been paid for.
