Well since Google updated the search results with the URL mysticky.net and mystickyz.com and the mystickyz.com owner is saying that Google hasn't spidered the links causes some debate. However, the time to spider a site depends on several factors, so no harm done.
Sue them. In small claims court preferably, or if in real court, represent yourself. They'll be forced to admit guilt, or defend themselves in court. Neither is a great option.

Did you patent the idea? As I'm pretty sure you can't sue someone or take action over a stolen idea without copyright/patenting protection.
I think it's probably too late for this particular situation. You may want to check on what is "patentable", such as the source code, etc. Also, check how to protect your concepts, domains and product names. Actually, we all probably should... It's one thing to have your content stolen, but I'm not sure how similar domains and such are factored in.
your right, you can't patent a site. you can only patent ideas, so you could have patented the idea of re-updateable stickies, or...something =)
The first rule in business is to get a good accountant. The second one is have and retain a good lawyer. I myself have two law firms on retainer, one of them specialises in business law and international and offshore tax, the other one' speciality is internet law and trademarks. To give you an idea, I pay a little over €15k per year in retainers to the lawyers and €5k per year to the accountant to keep my local taxes and business accounts legal. (the retainers give me a 50% off their normal rates and immediate attention to anything I need doing) One thing I would say is if you have an "idea", have your lawyer do a trademark search on the name and do a patent search and submit a patent application if nothing is pending. Get any logos and product names trademarked, as well as including a class for the domain name. Obviously if you intend on trademarking the product/company internationally, you will have to register a class for each country that you need protection, this is why companies like google, coca cola, nike, microsoft etc can kick everyones asses becasue they get their teams of lawyers to trademark everything, everywhere. Looking at all your posts in various forums and going by what you have said already, you say you earn "alot" of money, so getting a lawyer to sort this out will be chump change to you so why dont you do that instead? Maybe your Mummy and Daddy or a relative can help you find a good lawyer who specialises in this kind of thing.
That advice is no good for someone who making just 1 website. I honestly think that Hecky should just inprove his site and make it better than the 2nd site. It appears that the owner of the 2nd site is banned, i think that he is a dublicate account.. Rob
Absolutely and I would agree if he was just doing one web site, but he goes on and on about how great he is and how much money he makes every month from his online business etc as if he is Donald Trump, so really if he is playing with the bigger boys like he says he is, he should get his business in order and sort himself out with legal counsel and an accountant first rather than trying to be the Arthur Daley of the online world. May I also say, that alot of these kids who build these types of web sites and earn a monthly income from adsense etc or advertising, more than likely dont declare their income to the proper tax authorities so are in essence tax evaders. Then when they are in trouble, they cry and cry about how hard done by they have been when they are running businesses that fall outside of the law anyway. This is why you get an accountant first and a lawyer second becasue the tax authorities are out there and they will get you. My paddy friend told me something which is true..."Long runs the fox". Hecky will get what is due to him from the bloke that ripped him off but Hecky will also pay for his sins whatever they may be. Call it Karma, call it whatever you want, but no point in crying over spilt milk. Whatever site he makes next, someone is just going to rip it unless it legally protected in the proper fashion.
It sucks that your site got copied but it happens all the time. Coke vs Pepsi for example. Pepsi copies Coke's new flavors all the time, and something similar happened here. I can't agree with what Robert did but what he did what another person was bound to do anyway. He just managed to do it first. Age isn't a factor at this point. Hecky, don't waste your time posting in this thread. If you really care about this site, start doing something to make some money and fund the marketing of this site. No point in complaining about the stolen idea if you aren't going to do anything about it. If you are doing something about it though, besides posting about it, then you're on the right track to becoming a great business man. Speaking of which...I should go back and work on my own sites. Sorry to say this but I don't think you can pick and choose people's opinions on a forum just because you disagree with them. If someone is being abusive by all means report them. But I don't think anyone here has been abusive towards you here. Quite the opposite in fact, most people have been very supportive towards you and your site. Someone cloned your site, get over it. Immitation is the greatest form of flattery. If someone cloned your site it means you had something worthy of cloning! Instead of focusing on the negative aspect of being cloned you should go into marketing overdrive and push your site to the top (and keep it there). That's just my ten cents.
