Well said Jen. This is all i wanted to do but hecky came and opened a thread in the most busiest forum around. I know he is only 13 and still thinks the whole world is magical but as you said its business. Yes i dont even now why this thread is in legal issues coz it has nothing to do with legal issues but yet again a young boy that just wants to make a fuzz about someone using his ides. Ok you had a great idea but it has been taken to the next level that is the internet business
Go say that to children and elderly people, they would kick your ass. A forum is for all people over 13 (in compliance with the COPPA law), and teenagers I know on the forum are making thousands of dollars due to starting on the net at an early age. However, you people come and directly copy everything, domain idea, potential idea and everything about it. Mysticky not Mystickyz I hope will turn out to be the better one out of the two.

I don't normally comment on these cases but here goes: Hecky, if your 13 and came up with the idea and implemented this yourself (whether by hiring coders or doing the coding yourself etc), you've nothing to fear from losers that copy your site. Keep at it, add features, put the hard work into it and you'll leave this joker behind you. We've all had sites copied, and TBH a lot of the people who copy sites will do all they can do muscle over you. Make your site the best and you'll do just fine.

i totally agree with this statement. According to my sites awstats i've had 34 people download my website using some retarded program that should never have been made. Its life. On one hand "imitation is the highest form of flattery", so Hecky I guess you could be flattered by the other site. It is sad that Robert Kelso so blatantly used the similar format and domain name (although he does get points for style). Robert Kelso should really try to change the format. It's impressive that Hecky has done all this at such a young age. He's got quite a bright future and maybe this should be chocked up to experience, but I'm not saying to quit by any means. Keep up the good work! I don't think there's an easy answer to this.

man grow up google is a multi million dollar company and have trademarked there name if it wasnt trademarked they couldnt do anything. and google have advertised there brand everyone knows it so they dont want people using there name. mysticky.net opened 1 week before mine so even if i copied the name im getting nothing from it coz its not an established name or trusted im advertising from scratch, actually to be honest hecky will probly get some credbilaty from our site as we are heavily promoting . and finally even if he filled a trademark now he hasnt even got the .com plus its too late from the date it will be filed as i only registered a week after so i am aining nothing from using the so called same name
I don't know that suing will be a good answer. Are they even in the same country? It may be worth talking with a lawyer, just to see what they'd have to say. If Hecky did trademark it before all this started then he'd have some serious legal power. However, the reality still may not be in his favor. Has he made a lot of money from this? Can he afford a legal battle? Is it even worth it? I don't think this would be much of an issue if the domains were dissimilar and the format was very different. This is why Robert Kelso should probably change his format so it doesn't look like the other so much. I think 'sticky' is too generic to win a lawsuit on either side. Everyone knows that 'sticky' is just another name for a "Post It note". You might as well try to win by 'who promotes it best and who can keep their traffic on their own site'.
hecky only registered his domain a week before mine its not like he has had it for ages and i am taking his effort he has done no marketing as we are doing heavy marketing. So he may actually gain from our marketing
hmmm, i remember reading somewhere you can hide your source code for your site. Hecky in my opinion you should not have released your site untill EVERYTHING was done, copyright etc.. but yea good luck. You can do it buddy
