I had a posting contest on my forum. The winner was disputed, and I had one winner, a staff member did a recount, so I took a different winner, then I personally did another recount and made another winner. The prize of the contest was $150. The second winner (that was later over-turned) is now saying he will call my house if he doesn't get money. I had a disclaimer that I could DQ anyone, at any time, for any reason at all, or no reason. He says the money is his and he will contact a lawyer. Less-confusing version: Posting contest on my forum Person A won the contest Staff member did a recount, I awarded the prize to Person B I did a PERSONAL recount and re-awarded the prize to Person A. Can I threaten legal action for harassment if this person calls my house?
Haha. Let him hire a lawyer For $150, hes digging himself a bigger hole. Its your competition, your choice. Tell him that. And yes, you can if he calls your house after you telling him not to.
He's young, it's a null and void threat. I just don't want my mom picking up the phone She isn't the keenest on me doing work on the e-world, and a call like that wouldn't help.
HA LOL! Exact same case here. A 13 year old doesn't get much trust How does he know your phone number? And where do you live? Some phone companies will provide an ignore feature for like $1 a month where you can ignore phone numbers.
Everyone threatens legal action online. But in reality he won't, because A. Its only $150. Its not a huge sum of money. B. The cost of legal action is HUGE! $150 will buy you a phone call to a lawyer. Don't worry, you're safe. -Methane
He does have my number, we both live in the US. I have my whois protected, but he still got it!? He got an old number from before we moved, but it redirects to the new number.. unfortunately.
Lol, He probably won't do it. And if he does, And your mum answers, Take it and tell them to shove off. Tell your mum that it was a scammer/telemarketer/whatever and then ring the phone company and get them to block the number. I don't think your mum will disagree
Hmm, guess I hadn't of thought of those options.. Thanks guys. If she is really interested, I'll just tell her it's a disgruntled customer
Why don't you answer your phone? I've been calling for days. Kidding. How did they get your number? Maybe it would be worth changing it or blocking theirs, if you can.
He is a dumbass. Just say try it and when the lawyer calls say I had a disclamer that I could DQ someone. He will feel lower than dirt
Threaten to take legal action if he continues to call your house. State that the rules governing the contest were clearly stated and if he/she never took the time to read or understand them it is the fault of the contestant not the one hosting the event. That should fix it
$150 would be a small claims issue any way. In several states, one cannot have a lawyer with them in small claims court anyway. Beyond that, if he lives in another state then there is a good chance he could not file against you in any event (across state lines). Here's a link on what you could do for such a situation: http://www.privacyrights.org/fs/fs3-hrs2.htm
If he does call you, send him a formal cease and desist letter. There's really not much he can do beyond harassment.
