    If that's correct, you had no excuse for not making back-ups, even once a month, even if you're on a 14.4K dial-up.

    It's just pure ignorance. You could of easily made back-ups on the web host server, then made a thread in the sales board here mentioning you're on say 14.4K dial-up, offering to pay some one here that's on DSL or some fast connection (Some one with over say 1,000 posts and good iTrade feedback.), to download the back-ups, put them on a DVD or CD and mail them to you, and having them do this like once or twice a month. It would of been well worth the cost of a days income a month to have job insurance.

    Not making back-ups is the definition of a webmaster n00bie!!!!

    I'm pretty sure that since hes from India and not some big webmaster his average monthly salary will be .25 - 1 lakh max. Not to insult any indians (I'm one myself), but its just a fact.

    1 lakh is about 2500 USD. .25 is like 500 or something.

    Not so great money to run a household and spend money on other stuff.

    or a remote backup where you generate a full cpanel backup and choose to put it on another server ;)

    Perfect solution to make backups for large sites

    Dude, I'm 100% sure you are going to get another suspension from servage as soon as they get a complaint about your site offering Pirated Movies and ripped MP3s.
    You need to own the original DVD/VCD in order to have them ripped and backed up on hard drive/CD/DVD, additionally law forbids you to distribute the ripped version. Whoever is doing that is breaking a crime.

    Keep on going and soon you'll have MPAA after your ass.
    Check with servage, if they allow you to host MP3/Pirated movies on your server.

    There is not law requiring any web host (in the US anyway) to be backed up... You are free however, to sue...

    Hosting companies are not regulated by the FCC. As "information services", they are not governed by any regulatory body.

    Best thing to do is read your contract, then talk to an attorney if you think you want to go that route.

    They are not worth!!!

    They could give him/her a backup copy and let them go some place else.

    I don't see why they can't do it.

    I had DP member gave me hosting for $2.50 a month and then he went out of business, I requested backup and he helped me with that.

    I appreciated the help!

    Host should provide a backup.. They can ban/do what they want.

    The question is, how much was that data valuable for you to afford attorney fees

    Someone who is hosting a website to make let's say 1000$/month will not be able to pay attorney fees and law suite costs.

    Not to mention if you will get anything in return or not

    You can easily download a gzip backup from the cpanel control panel. 1 zipped file of everything, same for the data bases. Makes downloading even on a slow speed much easier than via ftp

    About Dreamhost, shared hosting and dedicated hosting.
    First off, I do host with Dreamhost and Godaddy (for shared hosting) and iWeb8 for dedicated.

    I too, have had problems with Dreamshost due to server load issues, andwas moved to a new, much better server after insisting that my server is "overloaded" with live sites.
    Since then, things have been smooth, and even heavily stumbleuponed sites worked well.
    And yes, your must BACKUP EVERYTHING. Have a copy of your entire sites and database dumps of like 1-2 weeks old on your hard-drive at all times. You never know when $6!7 will hit the fan.

    One can also argue webmasters should back up their stuff.

    At the end of the day, it's the agreement and its terms that matter.
